Ordinance No. 3,50021111 -2 ORDINANCE NO. 3500 AN ORDINANCE AMENDING SECTION 17--2, "FIREARMS AND TARGET RANGES" OF THE CODE OF ORDINANCES PROVIDING FOR AFFIRMATIVE DEFENSES; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Section 17 -2(B) 4 of the Code of Ordinances of the City of Baytown, Texas, is hereby amended to read as follows: "it is an affirmative defense to prosecution if such discharge was confined to a target range which holds a certificate of approval issued by the chief of police and the discharge was under the actual direction of an instructor certified by the Texas Commission on Law Enforcement Standards and Education, the National Rifle Association of America, or a military Reserve or Junior Reserve Officer Training Corps program, or such projectile was discharged within and confined by a bullet trap which holds a certificate of approval issued by the chief of police and was fired directly in such trap by a licensed gun dealer." Section 2: All ordinances or parts of ordinances incon- sistent with the terms of this ordinance, are hereby repealed provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. 21111 -2a Section 4. This ordinance shall take effect from and after its passage by the City Council.
