Ordinance No. 3,474Published: The Baytown Sun 21014 -3 Sunday, October 17, 1982 ORDINANCE NO. 3474 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF THE WEST DISTRICT WASTEWATER TREATMENT PLANT AND I -10 REST STOP AND ADJACENT LAND WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS FOR THE CITY OF BAYTOWN, TEXAS. WHEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexa- tion of the property described in Section 1 of this ordinance, was held at 7:00 p.m. in the City Council Chamber of the City Hall of the City of Baytown, Texas, on the 9th day of September, 1982, which date is not more than forty (40) nor less than twenty (20) days prior to the institution of annexation proceedings; and WHEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed an- nexation of the property described in Section 1 of this ordinance was held within the area proposed to be annexed at 5:30 p.m., on the 9th day of September, 1982, which date is not more than forty (40) nor less than twenty (20) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Baytown, Texas, and in the below described territory on the 27th day of August , 1982, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hear- ings; and WHEREAS, the total corporate area of the City of Baytown, Texas, on the 1st day of January 1982, was 29.10 square miles; and WHEREAS, the population of the City of Baytown, Texas is approximately 58,959 inhabitants; and 21014 --3a WHEREAS, the below described territory lies within the extraterritorial jurisdiction of the City of Baytown, Texas; and WHEREAS, the below described territory lies adjacent to and adjoins the City of Baytown, Texas; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the following described land and territory lying adjacent to and adjoining the City of Baytown is hereby added and annexed to the City of Baytown, Texas, and shall hereinafter be included within the boundary limits of the City of Baytown, Texas, and present boundary limits of such City, at the various point contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Baytown, Texas, to -wit: (EXHIBIT "A ") Section 2: The above described territory and the area so annexed shall be a part of the City of Baytown, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, and regulations of the City of Baytown, Texas. Section 3: In accordance with TEX.REV.CIV.STAT. art. 970a the service plan prepared by the City for providing municipal services to the annexed area is attached as Exhibit "B" and is hereby approved. The area is located on and around Highway Marker 883. The acreage proposed for annexation does abut a City of Baytown limits line in the south right -of -way line of IH -10. The Fire Department does not propose the addition of any new personnel, equipment or facilities. The area is in the service range of Fire District S. The Police Department does not propose the addition of any new personnel, equipment or facilities. The area will be assigned to Patrol Districts 1 and 7. The Public Works Department does not propose the addition of new personnel, equipment or facilities. The area will be serviced by an existing water well. Treatment of waste water will take place at the plant on site. Storm drainage will be to Spring Gully which is adjacent to the west side of the property. Interstate Highway 10 will provide street access. The Health Department also will not require additional personnel, equipment or facilities. Detailed Service Plans for each responding Department are on file and available for review in the City Clerk's Office.
