ORDINANCE NO. 3473
AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN
BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND
THE ANNEXATION OF LOVE'S TRUCK STOP, READING BUICK,
AND THE BAYTOWN AREA WATER AUTHORITY PLANT SITE
AND ADJACENT LAND WHICH SAID TERRITORY LIES
ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS
FOR THE CITY OF BAYTOWN, TEXAS.
WHEREAS, a public hearing before the City Council of the
City of Baytown, Texas, where all interested persons were
provided with an opportunity to be heard on the proposed annexa-
tion of the property described in Section 1 of this ordinance,
was held at 7:15 p.m. in the City Council Chamber of the City
Hall of the City of Baytown, Texas, on the 9th day of September,
1982, which date is not more than forty (40) nor less than twenty
(20) days prior to the institution of annexation proceedings; and
WHEREAS, a public hearing before the City Council of the
City of Baytown, Texas, where all interested persons were
provided with an opportunity to be heard on the proposed an-
nexation of the property described in Section 1 of this ordinance
was held within the area proposed to be annexed at 5:45 p.m., on
the 9th day of September, 1982, which date is not more than forty
(40) nor less than (20) twenty days prior to the institution of
annexation proceedings; and
WHEREAS, notice of such public hearing was published in a
newspaper having general circulation in the City of Baytown,
Texas, and in the below described territory on the 27th day
of August , 1982, which date is not more than twenty (20) nor
less than ten (10) days prior to the date of such public hear-
ings; and
WHEREAS, the total corporate area of the City of Baytown,
Texas, on the 1st day of January 1982, was 29.10 square miles;
and
WHEREAS, the population of the City of Baytown, Texas is
approximately 58,959 inhabitants; and

WHEREAS, the below described territory lies within the
extraterritorial jurisdiction of the City of Baytown, Texas; and
WHEREAS, the below described territory lies adjacent to and
adjoins the City of Baytown, Texas; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the following described land and territory
lying adjacent to and adjoining the City of Baytown is hereby
added and annexed to the City of Baytown, Texas, and shall
hereinafter be included within the boundary limits of the City of
Baytown, Texas, and present boundary limits of such City, at the
various point contiguous to the area hereinafter described, are
altered and amended so as to include said area within the
corporate limits of the City of Baytown, Texas, to -wit:

Section 2: The above described territory and the area so
annexed shall be a part of the City of Baytown, Texas, and the
property so added hereby shall bear its pro rata part of the
taxes levied by the City of Baytown, Texas, and the inhabitants
thereof shall be entitled to all of the rights and privileges of
all the citizens and shall be bound by the acts, ordinances,
resolutions, and regulations of the City of Baytown, Texas.
Section 3: In accordance with TEX.REV.CIV.STAT. art. 970a
the service plan prepared by the City for providing municipal
services to the annexed area is attached as Exhibit "B" and is
hereby approved.
Section 4: This ordinance shall be published and passed in
the manner provided in Article 1, Section 9, of the Charter of
the City of Baytown, Texas.

BEGINNING at a point on the South R.O.W. line of Interstate Highway 10 (form-
erly S.N. 73) at the Texas State Department of Highways and Public Transporta-
tion Station 934 + 00, said South R.O.W. line being the existing City of Bay-
town City Limit line;
THENCE, North 23° 13' 30" West for a distance of 300.00 feet along a line
that is perpendicular to the center line of IH -10 to a l" iron rod for a
point, said point being the Southeast corner of a 2.0458 acre tract, being part
of and out of Lot 1, Unit D of the Elena Fruit and Cotton Farm Subdivision in

SUMM. RY
The area proposed for annexation consists of approximately 104.252 acres in
the William Hilbus Survey No. 336. The area is located adjacent to Interstate
Highway 10, Thompson Road and Ellis School Road intersections.
The area abuts the city limits of Baytown in the IH -10 right -of -way on the
south side of the site.
The Fire Department does not propose the addition of any new personnel, equipment
or facilities. The area will be served by Fire District 5.
The Police Department will assign the area to Patrol Districts 1 and 7 for
police services. No new personnel, equipment or facilities will be required.
The Public Works and Health Departments will not require additional personnel,
equipment or facilities.
The area will be served by an existing 12 inch water line located along IH -10
and Thompson Road. Sewer service will be available from a proposed 10 inch
line near IH -10 and Thompson Road that will be constructed by the property
owners. Access to the properties will be by IH -10, Thompson Road or Ellis
School Road,
Detailed Service Plans for each responding Department are on file and available
for reveiw in the City Clerk's Office.
