Ordinance No. 3,47120924 -13 ORDINANCE NO. 3471 AN ORDINANCE ACCEPTING THE BID OF STEED - HOLLAND CO., INC., FOR THE SANITARY SEWER PROJECT AT THOMPSON ROAD & I -10 , AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF THIRTY FOUR THOUSAND FOUR HUNDRED FIFTY & 00 /100 ($34,450.00) DOLLARS WITH REGARD TO SUCH AGREEMENT; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the City Council of the City of Baytown did authorize the administration to advertise for bids for the Sanitary Sewer Project at Thompson Road and I -10 to be received September 20, 1982; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of TEX.REV.CIV.STAT. art. 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 a.m., Monday. September 20, 1982, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Steed - Holland Company, Inc. according to the plans and specifications set forth by the City Engineer on a construction timetable of 45 working days for the sum of Thirty Four Thousand Four Hundred Fifty & 00/100 ($34,450.00) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Steed - Holland Company, Inc. for the Sanitary Sewer Project at Thompson Road & I -10, containing the plans, specifications, and require- ments of the City Engineer and appropriate bond provisions in ac- cordance with the provisions of TEX.REV.CIV.STAT., art 5160. Section 2: That pursuant to the provisions of TEX. REV. CIV.STAT. art 2368a, the City Manager is hereby granted general authority to approve any change order involving an increase or a 20924 -13a decrease in costs of Fifteen Thousand and No /100 ($15,000.00) Dollars or less, provided that the original contract price may not be increased by more than twenty five (25 %) percent or decreased by more than twenty five (25) percent without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect form and after its passage.
