ORDINANCE NO. 3442
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN ESTABLISHING A STOP INTERSECTION ON TRI CITY
BEACH ROAD AT SPUR 55; REPEALING CONFLICTING ORDI-
NANCES; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A
MAXIMUM PENALTY OF TWO HUNDRED AND N01100 ($200.00)
DOLLARS; AND PROVIDING FOR THE PUBLICATION AND
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY COUNCIL OF
THE CITY OF BAYTOWN:
Section 1: That pursuant to the recommendation of the
Traffic Commission of the City of Baytown it is hereby declared
that the intersection on Tri City Beach Road at Spur 55 is
hereafter to be a stop intersection.
Section 2: The presently existing stop intersection on Spur
55 at Tri City Beach Road is hereby repealed.
Section 3: The Director of Planning and Traffic is hereby
authorized and directed to cause the proper signs to be posted at
the above described location.
Section 4: It shall be unlawful for the driver of a vehicle
to disobey the instruction of said signs placed in accordance
with the provisions of this ordinance, unless at the time
otherwise directed by a police officer.
Section 5: All ordinances or parts of ordinances incon-
sistent with the terms of this ordinance are hereby repealed;
provided, however, that such repeal shall be only to extent of
such inconsistency and in all other respects this ordinance shall
be cumulative of other ordinances regulating and governing the
subject matter covered by this ordinance.
Section 6: If any provision, section, exception, sub-
section, paragraph, sentence, clause or phrase of this ordinance
or the application of same to any person or set of circumstances,
shall for any reason be held unconstitutional, void or invalid,
such invalidity shall not affect the validity of the remaining
provisions of this ordinance or their application to other

persons or sets of circumstances and to this end all provisions
of this ordinance are declared to be severable.
Section 7: Any offense under this chapter for which another
penalty is not provided is a misdemeanor punishable by a fine of
not less than One ($1.00) Dollar nor more than Two Hundred
($200.00) Dollars, except that minors who have passed their
fourteenth birthday but have not reached their seventeenth
birthday shall be punished by a fine of not more than One Hundred
and NO /100 ($100.00) Dollars and each violation shall constitute
a separate offense.
Section 8: This ordinance shall take effect from and after
ten (10) days after its passage by the City Council. The City
Clerk is hereby directed to give notice hereof by causing the
caption of this ordinance to be published in the official news-
paper of the City of Baytown at least twice within ten (10) days
after its passage.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council on this the 12th day of August , 1982.
