Ordinance No. 3,438Published: The Baytown Sun 20812 -7 Tuesday, August 17, 1982 Wednesday, August 18, 1982 ORDINANCE NO. 3438 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN ESTABLISHING NO PARKING -TOW AWAY ZONES ON NORTHWOOD DRIVE; REPEALING CONFLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO 1100 ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That pursuant to the recommendation of the Traffic Commission of the City of Baytown it is hereby declared that the following described areas be NO PARKING - TOW AWAY Zones: a) The northside of Northwood Drive beginning at a point 350 feet east of Woodway Drive and continuing eastward a distance of 98 feet. b) The southside of Northwood Drive beginning at a point 353 feet east of Woodway Drive and continuing eastward a distance of 115 feet, and including the area dedicated to the City of Baytown as a bus turnaround by Ordinance No. 3398 which extends 50 feet south of the prior right -of -way line. Section 2: The Director of Planning and Traffic is hereby authorized and directed to cause the proper signs to be posted at the above described locations. Section 3: It shall be unlawful for the driver of a vehicle to disobey the instruction of said signs placed in accordance with the provisions of this ordinance, unless at the time otherwise directed by a police officer. Section 4: All ordinances or parts of ordinances incon- sistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance 20512 -7a shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 5: If any provision, section, exception, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 6: Any offense under this chapter for which another penalty is not provided is a misdemeanor punishable by a fine of not less than One ($1.00) Dollar nor more than Two Hundred ($200.00) Dollars, except that minors who have passed their fourteenth birthday but have not reached their seventeenth birthday shall be punished by a fine of not more than One Hundred and NO /100 ($100.00) Dollars and each violation shall constitute a separate offense. Section 7: This ordinance shall take effect from and after ten (10) days after its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official news- paper of the City of Baytown at least twice within ten (10) days after its passage.
