Ordinance No. 3,43520812 -4 ORDINANCE NO. 3435 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AUTHORIZING PAYMENT OF EIGHT THOUSAND EIGHT HUNDRED FIFTY EIGHT & N01100 ($8,858.00) DOLLARS TO HARRIS COUNTY MUD III AS THE CITY'S SHARE OF THE COST OF OVERSIZING A PROPOSED SANITARY SEWER LINE UNDER IH -10; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, Harris County MUD III proposes to tunnel under IH -10 in order to connect its sanitary sewer system to the existing City sewer system on the south side of IH -10; and WHEREAS, the City forsees additional development occurring north of IH -10 that may also need to tie into the City sanitary sewer system, which would require a larger line being put under IH -10 than presently being proposed; and WHEREAS, Harris County MUD III has taken bids for the proposed work, and included an alternate bid which would oversize the proposed line to allow for the future need to serve areas north of IH -10 foreseen by the City; and WHEREAS, the apparent low bidder proposes to build the alternate line desire by the City for a total of $1,661,060.50, of which the City of Baytown's share of the cost would be $8,858.00; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That payment of $8,858.00 to Harris County MUD III is hereby authorized as the City's share of the sewer line being proposed by Harris County MUD III, payment being contingent upon Cagle Construction Company signing a contract with Harris County MUD III to construct the proposed alternate sewer line desired by the City under IH -10. Section 2: This ordinance shall take effect from and after its passage by the City Council of the City of Baytown. 20812 -4a INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown on this the 12th day of August , 1982.
