ORDINANCE NO. 3428
AN ORDINANCE ACCEPTING THE BID OF CAT CONTRACTING,
INC., FOR THE CRAIGMONT- PONDEROSA WATER LINE REPLACEMENT,
AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE
CITY FOR THE SUM OF THREE HUNDRED THIRTY EIGHT THOUSAND
THREE HUNDRED SEVENTY THREE & N01100 ($33$,373.00)
DOLLARS.
WHEREAS, the City Council of the City of Baytown did
authorize the Consulting Engineers for the City of Baytown
to advertise for bids for the Craigmont- Ponderosa Water Line
Replacement, to be received July 1, 1982; and
WHEREAS, notice to bidders as to the time and place,
when and where the contract for said rehabilitation would be
let was published pursuant to provisions of TEX.CIV.REV.STAT.,
art. 2368a; and
WHEREAS, all bids were opened and publicly read at City
Hall at 10:30 a.m., Thursday, July 1, 1982, as per published
notice to bidders; 14OW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown
hereby accepts the bid of CAT Contracting, Inc., according to
the plans and specifications set forth by the City's Consulting
Engineers on a construction timetable of 80 days for the
sum of Three Hundred Thirty Eight Thousand Three Hundred Seventy
Three & No /100 ($338 .,373.00) Dollars, and the Ilayor and City
Clerk of the City of Baytown are hereby authorized and directed
to execute and attest to a contract with CAT Contracting, Inc.,
for the Craigmont- Ponderosa Water Line Replacement, containing
the plans, specifications, and requirements of the City's Con-
sulting Engineers and appropriate bond provisions in accordance
with the provisions of TEX.REV.CIV.STAT., art 5160.

Section 2: That pursuant of the provisions of TEX.REV.
CIV.STAT., art 2368a, the City Manager is hereby granted general
authority to approve any change order involving a decrease or
an increase in costs of Fifteen Thousand & No /100 ($15,000.00)
Dollars or less, provided that the original contract price may
not be increased by more than twenty -five (25 %) percent or de-
creased by more than twenty -five (25 %) percent withhout the con-
sent of the contractor of such decrease.
Section 3: This ordinance shall take effect from and
after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of
the City Council of the City of Baytown on this the 22nd day of
