Ordinance No. 3,41920703 -2 ORDINANCE NO. 3419 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN APPROVING THE PLANS AND SPECIFICATIONS OF BUSCH- HUTCHINSON & ASSOCIATES, INC. FOR THE CALDWELL STREET IMPROVEMENT PROJECT; AWARDING THE CONTRACT FOR SAID PROJECT TO ABLE SERVICES OF HOUSTON FOR ONE HUNDRED SEVENTY SIX THOUSAND FIVE HUNDRED SEVENTY & N01100 ($176,570.00) DOLLARS; DIRECTING THAT NO WORK BE STARTED ON SAID PROJECT UNTIL COMPLETION OF THE ASSESSMENT PROCEEDINGS; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, by Ordinance No. 3364 Council did determine the necessity for and ordered the permanent improvement of Caldwell Street; and WHEREAS, a part of the costs of this improvement are proposed to be assessed against the property and owners of property abutting the Caldwell Street Improvement Project; and WHEREAS, the City Council did authorize advertising for bids for the Caldwell Street Improvement Project to be re- ceived June 29, 1982; and WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was published pur- suant to provisions of Section 74 of the Charter of the City of Baytown; and WHEREAS, all bids were opened and publicly read at City Hall at 9:30 a.m., Tuesday, June 29, 1982, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Able Services of Houston for the sum of One Hundred Seventy Six Thousand Five Hundred Seventy & No /100 ($176,570.00) Dollars, and the Mayor and City Clerk are hereby authorized and directed to execute and attest to a contract with Able Services of Houston, for the Caldwell 20708 -2a Street Improvement Project, containing the plans, specifica- tions, and requirements of the Consulting Engineers and appropriate bond provisions in accordance with the provisions of TEX.REV.CIV.STAT., art. 5160. Section 2: That no work shall be started on this project until completion of the assessment proceedings. Section 3: That pursuant to the provisions of TEX.REV. CIV.STAT. art 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Fifteen Thousand and No /100 ($15,000.00) Dollars or less, provided that the original contract price may not be increased by more than twenty five (250) percent or decreased by more than twenty -- five (257o) percent without the consent of the contractor to such decrease.
