Ordinance No. 3,392Published: The Baytown Sun 20527 -2 Tuesday, June 1, 1982 Wednesday, June 2, 1952 ORDINANCE NO. 3392 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 12, "FIRE PREVENTION AND PROTECT- ION", OF THE CODE OF ORDINANCES TO ALLOW THE ISSUANCE OF FOUNDATION PERMITS PRIOR TO THE INSTALLATION OF WATER LINES AND FIRE HYDRANTS; REPEALING CONFLICTING ORDINANCES; CON- TAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Chapter 12, "Fire Prevention and Protection ", Section 12- 47(o), "Requirements of fire lane easements',' which shall read as follows: Sec. 12 -47. Requirements of fire lane easements. (o) No building permit other than a foundation permit may be issued for the construction of buildings under this section until such time as the water lines and fire hydrants necessary for protection have been constructed in a manner suitable to the fire chief or his designated representative. Flammable materials may not be stockpiled on a building site under a foundation permit, and such stockpiling shall be grounds for revoking a foundation permit. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, how- ever, that such repeal shall be only to the extent of such incon- sistency and in all other respects this ordinance shall be cumula- tive of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such in- validity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets 20527 --2a circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: Any person violating the provisions of this ordinance shall be punished by a fine of not more than Two Hun- dred and No /100 ($200.00) Dollars, and each violation shall con- stitute a separate offense. Section 5: This ordinance shall take effect from and after ten (10) days after its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official news- paper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
