Ordinance No. 3,39020513 -15 ORDINANCE NO. 3390 AN ORDINANCE AWARDING THE CONTRACT FOR COMMUNITY DEVELOPMENT REHABILATION PROJECT #81 -04 -06 TO ED SHOOK BUILDING CONTRACTOR, INC., FOR THE SUM OF EIGHT THOUSAND NINE HUNDRED NINETY NINE & 99/100 ($8,999.99) DOLLARS. WHEREAS, the City of Baytown's Community Development Program did advertise for bids for Community Development Program Rehabilitation Project #81 -04 -06 to be received May 4, 1982; and WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was published purusant to provisions of Section 74 of the Charter of the City of Baytown, and WHEREAS, all bids were opened and publicly read at the Community Development Office at 10:00 a.m., Tuesday, May 4, 1982, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Ed Shook for the sum of Eight Thousand Nine Hundred Ninety Nine & 99/100 ($8,999.99) Dollars, for Community Development Rehabilitation Project #81 -04 -06 being the repair and rehabilitation of 803 Mayo Street, providing that no money will be paid to said Contractor until completion and acceptance of the work by the Owner and the Baytown Community Development Program. Section 2: That pursuant to the provisions of TEX.REV. CIV.STAT. art. 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, provided that the original contract price may not be increased by more than ten (10 %) 20513 -15a percent or decreased by more than twenty -five (250) percent without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect from and its passage. The City Council of the City convened in regular meeting on the 27th day of May, 1982, at the regular meeting place thereof, within the City, and the roll was called of the duly constituted officers and members of the City Council and the City Clerk, to -wit: Emmett O. It was then duly moved and seconded that the Ordinance be adopted; and, after due discussion, said motion, carrying with it the adoption of the Ordinance, prevailed and carried by the fol- lowing vote: AYES: All members of the City Council shown present above voted "Aye ". NAYS: None. 2. That a true, full and correct copy of the Ordinance adopted at the meeting described in the above and foregoing paragraph is attached to and follows this certificate; that the Ordinance has been duly recorded in the City Council's minutes of said meeting; that the above and fore- going paragraph is a true, full and correct excerpt from the City Council's minutes of said meeting pertaining to the adoption of the Ordinance; that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting officers and members of the City Council as indicated therein; that each of the officers and members of the City Council was duly and sufficiently notified officially and personally, in advance, of the date, hour, place and subject of the aforesaid meeting, and that the Ordinance would be introduced and considered for adoption at said meeting, and each of said officers and members consented, in advance, to the holding of such meeting for such purpose; that said meeting was open to the public as required by law; and that public notice of the date, hour, place and subject of said meeting was given as required by Vernon's Article 6252 -17, as amended.
