Ordinance No. 3,38220513 -7 ORDINANCE NO. 3382 AN ORDINANCE ACCEPTING THE BID OF JOHN REYNOLDS & SONS, INC., FOR THE REHABILITATION OF WEST DISTRICT SEWAGE COLLECTION SYSTEM, SEWER LINE REPLACEMENT, SLIPLINING AND POINT REPAIR, JOB NO. 044 -15, CONTRACT NO. 3; AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF SIX HUNDRED FIFTY FIVE THOUSAND TWO HUNDRED NINETY TWO & 35/100 ($655,292.35) DOLLARS. WHEREAS, the City Council of the City of Baytown did authorize the Consulting Engineers for the City of Baytown to advertise for bids for the rehabilitation of West District Sewage Collection System, Sewer Line Replacement, Sliplining and Point Repair, Job No. 044 -15, Contract No. 3 to be re- ceived April 15, 1982. WHEREAS, notice to bidders as to the time and place, when and where the contract for said rehabilitation would be let was published pursuant to provisions of TEX.CIV.REV.STAT. art 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 a.m., Thursday, April 15, 1982, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section l: That the City Council of the City of Baytown hereby accepts the bid of John Reynolds & Sons, Inc., contin- gent upon U. S. Environmental Protection Agency approval, according to the plans and specifications set forth by the City's Consulting Engineers on a construction timetable of 200 calendar days for the sum of Six Hundred Fifty Five Thousand Two Hundred Ninety Two & 35/100 ($655,292.35) Dollars, and the Mayor and City Clerk of the City of Baytown are hereby authorized and directed to execute and attest to a contract with John Reynolds & Sons, Inc., of Paoli, Indiana, 20513 -7a for the rehabilitation of the West District Sewage Collection System, Sewer Line Replacement, Sliplining and Point Repair, containing the plans, specifications, and requirements of the City's Consulting Engineers and appropriate bond provisions in accordance with the provisions of TEX.REV.CIV.STAT., art 5160. Section 2: That pursuant to the provisions of TEX.REV. CIV.STAT. art 2368a, the City Manager is hereby granted gen- eral authority to approve any change order involving a de- crease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, provided that the original contract price may not be increased by more than twenty -five (25 %) percent or decreased by more than twenty -five (25 %) percent with the consent of the contractor of such decrease.
