Ordinance No. 3,354Published: The Baytown Sun 20325 -1 Sunday, March 28, 1982 ORDINANCE NO. 3354 AN ORDINANCE PROVIDING FOR THE BOUNDARY LIMITS OF THE CITY OF ANNEXATION OF GOOSE CREEK SHOP LAND WHICH SAID TERRITORY LIES THE PRESENT BOUNDARY LIMITS OF TEXAS. EXTENSION OF CERTAIN BAYTOWN, TEXAS, AND THE PING CENTER AND ADJACENT ADJACENT TO AND ADJOINS THE CITY OF BAYTOWN, WHEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the property described in Section 1 of this ordinance, was held at 7:00 p.m, in the City Council Chamber of the City Hall of the City of Baytown, Texas, on the 11th day of March, 1982, which date is not more than forty (40) nor less than twenty (20) days prior to the institution of annexation proceedings; and WHEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the property described in Section 1 of this ordinance was held within the area proposed to be annexed at 5:30 p.m., on the 11th day of March, 1982, which date is not more than forty (40) nor less than twenty (20) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Baytown, Texas, and in the below described territory on the 28th day of February, 1982, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearings; and WHEREAS, the total corporate area of the City of Baytown, Texas, on the 1st day of January 1982, was 29.10 square miles; and 20325 -1a WHEREAS, the population of the City of Baytown, Texas is approximately 58,238 inhabitants; and WHEREAS, the below described territory lies within the extraterritorial jurisdiction of the City of Baytown, Texas; and WHEREAS, the below described territory lies adjacent to and adjoins the City of Baytown, Texas; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the following described land and territory lying adjacent to and adjoining the City of Baytown, Texas, and shall hereinafter be included within the boundary limits of the City of Baytown, Texas, and present boundary limits of such City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Baytown, Texas, to -wit: (SEE EXHIBIT "A ") Section 2: The above described territory and the area so annexed shall be a part of the City of Baytown, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, and regulations of the City of Baytown, Texas. Section 3: In accordance with TEX.REV.CIV.STAT, art 970a the service plan prepared by the City for providing 9.L 20325 -1b municipal service to the annexed area is attached as Exhibit "B" and is hereby approved. Section 4: This ordinance shall be published and passed in the manner provided in Article 1, Section 9, of the Charter of the City of Baytown, Texas. HALL, City Clerk APPROVED: ANDAL B.-STRUNG, Cit ttorney in z0325-1c EXHIBIT "A" FIELD NOTES FOR GOOSE CREEK SHOPPING CENTER BEING a parcel or tract of land containing 3.54 acres out of Block 19 of Highland Farms Subdivision, Harris County, Texas, as recorded in Volume 10 at Page 47 of the Map Records of Harris County, and being a part of that certain tract of land conveyed to William B. Ramsey by Bernard J. Murski and wife in deed recorded in Volume 6918 at Page 462 of the Deed Records of Harris County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at the point of intersection of the East right -of -way line of Garth Road, as widened, with the North right -of -way line of Sharon Road, said point marked with a 3/4" iron rod; THENCE North 78° 26' 25" East with the North right -of -way line of Sharon Road a distance of 245' to a point called the POINT OF BEGINNING; THENCE North 06° 30' 30" West a distance of 434.34' along a line parallel to the East right -of -way line of Garth Road, as widened; THENCE North 78° 26' 26" East with an old fence, a distance of 354.991 to a 9" fence post marking the Northeast corner of this tract; THENCE South 060 30' 30" East a distance of 434.34' to an iron pipe lo- cated in the North right -of -way line of Sharon Road marking the Southeast corner of this tract; THENCE South 780 26' 26" West with the North right -of -way line of Sharon Road a distance of 354.991 to the POINT OF BEGINNING, enclosing a tract of land containing 3.54 acres, more or less. 2/19/82 20325 —xd EXHIBIT "B" GOOSE CREEK CENTER SERVICE PLAN NARRATIVE The land proposed for annexation is an area of 3.54 acres known as Goose Creek Center. This development is located in the northeast quadrant of the intersection of Garth Road and Sharon Lane. The land is located in Block 19 of the Highland Farms Subdivision, Harris County, Texas. The area proposed for annexation does abut the existing limit on the west side, near the eastern right -of -way of Garth Road. Detailed Service Plans for each City Department concerned is available in the City Clerk's Office for individual analysis. No Department surveyed anticipates the need for any new city buildings, personnel or equipment. All Departments concerned will commence applicable services upon completion of the Center, when construction begins, or upon completion of the annexation process, as appropriate. The area annexed will become a part of Fire District 6 and Patrol Zone 7. Access to the property will be from Garth Road. Water and Sanitary Sewer services are also available in Garth Road. Refuse pickup is not provided by the City for commercial developments, so this service plan is not necessary. Drainage facilities are provided by part of San Jacinto Mall's detention facility.
