Ordinance No. 3,33820225 -10 OR')IT- IA'1C? 110. 3338 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN TEXAS, AUTHORIZING AND DIRECTING THE CITY '''- IANAGER OF THE CITY OF BAYTOWN TO EXECUTE A LEASE WITH THE ALFRED COMPANY TO LEASE CERTAIN PREnISES LOCATED AT 1722 MARKET STREET; AUTHORIZING PAYMENT BY THE CITY; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section l: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the City Manager to execute a contract with The Alfred Company to lease certain premises known as Suite 4 of the building located at 1722 Market Street, being an area of approximately 580 square feet for the sum of Four Thousand Thirty -Six & No /100 ($4,440.00) Dollars per year plus a prorata share of the utility expenses and authorizing an option to renew said lease at that amount for an additional one -year term. Section 2: This ordinance shall take effect from and after its passage. STRONG, City torney 20225 -I0a E X H I B I T "A" 20225 -10b THE STATE OF TEXAS 0 0 LEASE AGREEMENT COUNTY OF IIARRIS 0 This is a lease agreement made and entered into by and between The Alfred Company, hereinafter called LESSOR, and the City of Baytown, a Municipal corporation, herein- after called LESSEE. It is agreed as follows: I. Lessor agrees to let to Lessee those certain premises known as Suite 4 of the building located at 1722 Market Street, being an area of approximately 580 square feet. II. Lessee agrees to pay to Lessor the sum of Three Hundred Seventy & No /100 ($370.00) Dollars per month, said monthly payments to be made on the tenth day of each month, the first monthly payment of Three Hundred Seventy Fz No /100 ($370.00) Dollars being due on the 10th day of March, 1982. III. This lease shall be for a term of one (1) year, begin- Ding A4arch 1, 1982, and ending Februrary 28, 1983. IV. Lessee agrees to pay its prorata share of the electri- city, gas, and water utilities furnished the premises for the term of this lease. V. In addition to the leased premises which Lessee shall have the exclusive use of, Lessee shall have the right to use (with the other tenants of the building) the lobby, hallways, restrooms, and entrances of said building. VI. During the term of this lease, Lessor will at his expense keep and maintain in good repair the exterior walls, exterior doors, exterior doorways, windows, roof, structural 20225 -10c portions, heating equipment, air conditioning equipment, plumbing, lobby, hallways, electrical equipment and wiring, office space walls, office space doors, and office doorways of said building. vII . Lessor agrees that Lessee shall have the option to lease the premises for a further term of one (1) year at the same rental rate-and upon the same terms and conditions as are provided for in this lease. Lessee shall exercise this option by giving written notice of intent to extend for a further term of one (1) year not less than forty -five (45) days prior to the expiration date of this lease. VIII. Lessor understands that this lease is predicated and conditioned on the City of Baytown receiving approval of this agreement and funds for the purpose of paying the entire obligation of the City under this Agreement from the Community Development Program administered by the Department of Housing and Urban Development. Notwithstanding anything to the contrary in this Agreement, the Lessee may terminate this agreement by giving sixty (60) days` notice in writing to Lessor upon the Department of Housing and Urban Develop- ment termination of funding of this lease agreement. IY. This lease agreement shall be binding on the heirs, executors, successors and assigns of the parties. EXECUTED this the day of CITY OF BAYTOWN . 1952.
