Ordinance No. 3,295ORDINANCE, NO. 3295 AN ORDINANCE CLOSING AND VACATING THE UTILITY EASEMENT IN LOT 3, BLOCK 5, OF DECKER TERRACE SUBDIVISION, AND PROVIDING FOR THE DISPOSITION OF SAID PROPERTY. WHEREAS, Section 26 -51 of the Code of Ordinances of the City of Baytown provides for the abandonment of City easements; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That, upon receipt by the City from U.S. Homes, Corp. of One Hundred and No /100 ($100.00) Dollars the hereinafter described public utility easement in Lot 3, Block 5, of Decker Terrace Subdivision, be and the same is hereby extinguished, vacated, closed, and permanently abandoned as an easement for public utilities: A portion of a 5 foot easement located on the west side of Lot 3, Block 5 of Decker Terrace Subdivision which includes that portion of the easement which has been covered by a house and also that portion of the easement running along the west side of the concrete driveway located on said lot to the front boundary line of said property. A map is attached hereto and marked Exhibit "A" showing the portion of the 5 foot easement to be abandoned. Section 2: That upon said receipt, the fee to the land in said easement above described is hereby released and shall revert to the owner as provided by law, and the mayor is authorized to deliver a quitclaim deed to U. S. Homes, Corp. Section 3: ':"hat all ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: The necessity to abandon the easement creates a public emergency and this ordinance shall be in effect from and after its passage.
