Ordinance No. 3,29320114 -3 ORDINANCE NO. 3293 AN ORDINANCE AMENDING CHAPTER 1721, "MOBILE HOMES & MOBILE HOME PARKS', OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN BY AMENDING ARTICLE III, "MOBILE HOMES OUTSIDE PARKS, SECTION 17? -15 , "PARKIINTG OF T'IOBILE HOME OUTSIDE OF LICENSED MOBILE HOME PARK ", SUBSECTION 13; AND BY AMENDING CHAPTER 171., BY THE ADDITION OF A !NEW SECTION, SECTION 171 -16 OF ARTICLE III, ENTITLED, ESTABLISHED MOBILE HOME STANDS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND FFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the Code of Ordinances of the City of Baytown, Texas, is hereby amended by the amendment of Chap- ter 171., "Mobile Homes Fz Mobile Home Parks ", Article III, 1";L.Iobile Homes outside Parks ", Section 171 --15, "Parking of mobile homes outside of licensed mobile home parr ", subsec- tion (13), as presently constituted and by substituting a new subsection 172 - 15(13) which shall read as follows: Section 172 -15. Parking of mobile outside of licensed mobile home park. (13) All streets and driveways shall be provided with a surface composed of hot asphaltic concrete (hot or cold laid), reinforced concrete (5.0 sack mix), stabilized shell, or stabilized sand and which shall be durable and well- drained under normal use and weather condi- tions. Pavement edges shall be protected to prevent raveling of the wearing surface and shifting of the pavement base. Street and driveway surfaces shall be maintained free of dust, cracks, holes, and other hazards. Section 2: 'What the Code of Ordinances of the City of Baytown, Texas, is hereby amended by the addition of a new section, Section 17 -16, of Article III entitled "Established Mobile Stands ", which shall read as follows: Section 17 -16. Established Mobile Home Stands. Where a person owned a mobile home prior to the enactment of this article, and such rlobile hor~i�� has not been moved to a new stand or location since that date, then that person shall not be subject to the requirements of this article. Nor shall the requirements of this article apply to the replacement of a mobile home by the owner of a mobile home where such home existed prior to the enactment of this article and such mobile home has not been removed from its stand or location since this article's enactment. 20114 -3a Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject natter covered by this ordinance. Section 4: If any provision, section, exception, sub- section, paragraph, sentence, clause or phrase of this ordi- nance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to the persons or set of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect from and after its passage.
