Ordinance No. 3,28011210 -2 ORDINANCE NO. 3280 AN ORDINANCE ACCEPTING THE BID OF McKEY CONSTRUCTION AND EQUIPMENT, INC., FOR THE CONSTRUCTION OF WEST DISTRICT SEWAGE CONVEYANCE SYSTEM AND EFFLUENT FORCE MAIN -- CONTRACT NO. 4; AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF ONE MILLION SIXTY THREE THOUSAND FOUR HUNDRED ELEVEN & 50/100 ($1,063,411.50) DOLLARS. WHEREAS, the City Council of the City of Baytown did authorize the Consulting Engineers for the City of Baytown to advertise for bids for the construction of the West Dis- trict Sewage Conveyance System and Effluent Force Main - -Con- tract No. 4 to be received Tuesday, December 1, 1981, and WHEREAS, notice to all bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of TEX.CIV. REV.STAT. art 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 3:00 p.m., Tuesday, December 1, 1981, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section l: That the City Council of the City of Baytown hereby accepts the bid of McKey Construction and Equipment, Inc. contingent upon U. S. Environmental Protection Agency and Texas Department of Water Resources approval, according to the plans and specifications set forth by the City's Consulting Engineers on a construction timetable of 200 calendar days for the sum of ONE MILLION SIXTY THREE THOUSAND FOUR HUNDRED ELEVEN & 50/100 ($1,063,411.50) DOLLARS, and the Mayor and City Clerk of the City of Baytown are hereby authorized and directed to execute and attest to a contract with McKey Construction and Equipment, Inc., for the constru- ction of the West District Sewage Conveyance System and 11210 -2a Effluent Force Main and containing the plans, specifications, and requirements of the City's Consulting Engineers and appropriate bond provisions in accordance with TEX.REV.CIV.STAT. art 5160. Section 2: That pursuant to the provisions of TEX.REV. CIV.STAT. art 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, provided that the original contract price may not be increased by more than twenty -five (25 %) per cent or decreased by more than twenty --five (250) percent without the consent of the contractor of such decrease.
