ORDINANCE NO. 3273
AN ORDINANCE ACCEPTING THE BID OF BRY PLUMBING, INC.
FOR THE IH -10 WEST WATERLINE AND AUTHORIZING THE PAY-
MENT BY THE CITY OF BAYTOWN OF THE SUM OF TWENTY THREE
THOUSAND THREE HUNDRED FIFTY THREE & 71/100 ($23,353.71)
DOLLARS.
WHEREAS, the City Council of the City of Baytown did
authorize the City Engineer for the City of Baytown to
advertise for bids for the construction of the IH -10 West
Waterline, to be received November 20, 1981; and
WHEREAS, notice to bidders as to the time and place
when and where the contract would be let was published
pursuant to the provisions of TEX.REV.CIV.STAT. art. 2368a;
and
WHEREAS, all bids were opened and publicly read at City
Hall at 10:00 a.m., November 20, 1981, as per published
notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the City Council of the City of
Baytown hereby accepts the bid of BRY PLUMBING, INC., accord-
ing to the plans and specifications set forth by the City
Engineer for the sum of Twenty Three Thousand Three Hundred
Fifty Three and 71/100 ($23,353.71) Dollars, and the Mayor
and City Clerk of the City of Baytown are hereby authorized
and directed to execute and attest to a contract with BRY
PLUMBING, INC. for the construction of the IH -10 West Water-
line, said contract containing the plans, specifications,
and requirements of the City Engineer and appropriate bond
provisions in accordance with the provisions of TEX.REV.CIV.
STAT. art. 5150.

Section 2: That the award of this Contract is contingent
upon the receipt of $23,353.71 from Reading Buick, Inc. and
Don Hamm, III, as the developers'share of the costs of these
extensions.
Section 3: That pursuant to the provisions of TEX.REV.
CIV.STAT. art 2368a, the City Manager is hereby granted
general authority to approve any change order involving a
decrease or an increase in costs of Five Thousand and No /100
($5,000.00) Dollars or less, provided that the original
contract price may not be increased by more than twenty -five
(25 %) per cent without the consent of the contractor of such
decrease.
Section 4: This ordinance shall take effect from and
after its passage.
