Ordinance No. 3,272111.24 --4 ORDINANCE NO. 3272 AN ORDINANCE ACCEPTING THE BID OF NAYLOR INDUSTRIES, INC. FOR THE CONSTRUCTION OF WEST DISTRICT SEWER REHABILI- TATION PROJECT -- CONTRACT NO. 2; AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF THREE HUNDRED SEVEN THOUSAND TWO HUNDRED NINE & 30/100 ($307,203.30) DOLLARS. WHEREAS, the City Council of the City of Baytown did authorize the Consulting Engineers for the City of Baytown to advertise for bids for the construction of the West Dis- trict Sewer Rehabilitation Project --- Contract No. 2 to be received on Friday, November 20, 1981. WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of TEX.CIV.REV. STAT. art 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at10-,00 a.m., Friday, November 20, 1981, as per publish- ed notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Naylor Industries, Inc., contingent upon U. S. Environmental Protection Agency ap- proval, according to the plans and specifications set forth by the City's Consulting Engineers on a construction time- table of 200 calendar days for the sum of THREE HUNDRED SEVEN THOUSAND TWO HUNDRED NINE & 30/100 ($307,209.30) DOLLARS, and the Mayor and City Clerk of the City of Baytown are hereby authorized and directed to execute and attest to a contract with Naylor Industries, Inc., of Pasadena, Texas, for the rehabilitation of the existing sanitary sewer lines and manholes in West District Sanitary Sewer System contain- ing the plans, specifications, and requirements of the City's Consulting Engineers and appropriate bond provisions 11124 -4a in accordance with the provisions of TEX.REV.CIV.STAT. art 5160. Section 2: That pursuant to the provisions of TEX. REV.CIV.STAT. art 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, provided that the origi- nal contract price may not be increased by more than twenty - five (25 %) percent or decreased by more than twenty (250) percent with the consent of the contractor of such decrease.
