Ordinance No. 3,269Published: The Baytown gun Tuesday, December 1, 1981 ORDINANCE NO. 3269 111.24 -1 AN ORDINANCE PROVIDING FOR OF EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF RAVEN WAY SUBDIVISION AND ADJACENT LAND WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. WHEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the property described in Section 1 of this ordinance, was held at 7:00 p.m. in the City Council Chamber of the City Hall of the City of Baytown, Texas, on the 22nd day of October , 19 81 , which date is not more than forty (40) nor less than twenty (20) days prior to the institution of annexation proceedings; and WHEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the property described in Section 1 of this ordinance was held within the area proposed to be annexed at 5:30 p.m., on the _- 22nd day of October , 1981, which date is not more than forty (40) nor less than twenty (20) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearings was published in a newspaper having general circulation in the City of Baytown, Texas, and in the below described territory on the 11th day of October �, 19 81 , which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearings; and WHEREAS, the total corporate area of the City of Baytown, Texas, on the lst day of January 1981, was 28.79 square miles; and 1.1124 -1a WHEREAS, the population of the City of Baytown, Texas is approximately 56,650 inhabitants; and , WHEREAS, the below described territory lies within the extraterritorial jurisdiction of the City of Baytown, Texas; and WHEREAS, the below described territory .lies adjacent to and adjoins the City of Baytown, Texas; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That Ordinance Number 3171, which was passed on the Second and Final Reading on July 23, 1981, is hereby declared null and void and of no further force and effect. Section 2: That the following described land and territory lying adjacent to and adjoining the City of Baytown is hereby added and annexed to the City of Baytown, Texas, and shall hereinafter be included within the boundary limits of the City of Baytown, Texas, and present boundary limits of such City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Baytown, Texas, to -wit: (SEE EXHIBIT "A ") Section 3: The above described territory and the area so annexed shall be a part of the City of Baytown, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, and regulations of the City of Baytown, Texas. EM 11124 -1b Section 4: In accordance with TEX.REV.CIV.STAT. art 970a the service plan prepared by the City for providing municipal service to the annexed area is attached as Exhibit "B" and is hereby approved. Section 5: This ordinance shall be published and passed in the manner provided in Article 1, Section 9, of the Charter of the City of Baytown, Texas. The land is located in the Christian Smith Survey A -69, D. J. W. Singleton Survey A -709 and the D. M. McFaddin Survey A -591, Harris County, Texas. The area proposed for annexation does abut the existing city limits on the north, west and south. The Service Plans for the individual departments concerned are attached and made a part of the document. The Fire Department proposes not to hire any additional personnel and indicates that no additional equipment nor fire station's will be required. The area will be added to Fire District #6. The Health Department does not foresee the need for additional personnel, equipment or structures to serve the area. The Police Department will not require any additional equipment, building or personnel to serve the area. Zone 3. It will be added to Patrol District 8, The Inspection Department will issue building permits and inspect construction for new homes or buildings in the area when it begins to develop. They do not anticipate any new city structures, personnel or equipment to serve the area to be annexed: The Public Works Department also does not anticipate additional city personnel, structures or equipment to service the area. Water service is available from an S in-_'- line along Massey Tompkins; sewer service will be available from an 8 inch line that will run along the railroad track. These are both adequate to serve the area. Drainage will be into the railroad ditch and north to a flood control ditch. Street access will be from Massey Tompkins Road. When construction begins in the subdivision, the engineering work will be inspected as it progresses. Once new homes are there, the solid waste pick -up will be added to the Massey Tompkins route. 11124 -1g FIRE PROTECTION SERVICE PLAN FOR Raven Way Subdivision and Adjacent Area 35.63 -acre tract of Christen Smith Survey A -69, D. The health department routinely inspects all areas within the City of Baytown for possible health violations. Newly annexed areas will be routinely inspected in the same manner as other areas in the City. 3. The annexation will require the purchase of Such purchase, if necessary, will be made within two and one -half years of the date of annexation. 5. Singleton Survey A- D.M. McFaddin Survey A- -591, Harris County, Texas. 2. The Inspection Department routinely inspects and issues building permits for construction within the City of Baytown. Construction in the newly annexed area will be inspected in same manner as other areas in the City, commencing with annexation date. 3. The annexation of this area will /will not require the construction of additional buildings. 4. The annexation will require the addition of NO inspection employees to the Baytown Inspection Department. The City of Baytown will hire such additional employees as qualified applicants become available. 5. The annexation will require the purchase of NO Such purchase, if necessary, will be made within two and one -half years of the d"te of annexation. The equipment, if any, is attached hereto as Exhi -` "A". K C ER, Chief Inspector 1.1124 -1k PUBLIC WORKS SERVICE PLAN FOR: 1. Area being annexed: Approximately 35 acre tract adjacent to and north of Massey Tompkins Road and abutting the Southern Pacific Railroad right -of- way. 2. The subdivider who has asked for the annexation of the above area will con- struct the water lines, sewer lines, streets, and drainage facilities that serve his area, and will also be responsible for providing street lighting. All construction will be to City of Baytown engineering standards and the construction will be inspected by City of Baytown personnel. A copy of the engineering plans showing the details of this construction will be available for public inspection in the City Engineer's office. Water service is available from an 8" water line on Massey Tompkins Road immediately south of this area. Sanitary sewer service will be provided by an 8" gravity line that flows from the railroad tracks to McKinney Road. Both utilities are adequate to provide service to this area.. The City of Baytown has sufficient water as well as sufficient capacity at its sewer treatment plants to serve this area at the same level as other areas presently in the City of Baytown. 3. Storm drainage will flow to the railroad ditches and then north to a Harris County Flood Control ditch. 4. Street access will be provided from Massey Tompkins Road. 5. Maintenance of water lines, sewer lines, streets and drainage will be pro- vided by the public works department through its program of regular inspec- tion and repair. The Public Works Department has sufficient equipment and personnel in this year's budget to inspect and maintain this area at the same level of service as other areas in the City. b. The City of Baytown will provide solid waste pick -up by adding this area to the Massey Tompkins route.
