ORDINANCE NO. 3243
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AMENDING CHAPTER 28, "SWIMMING POOLS," SUBSECTION
28 -6 OF THE CODE OF ORDINANCES, TO PROVIDE FOR AN
INCREASE IN THE FEE FOR PUBLIC SWIMMING POOL LICENSES;
A NEW DATE FOR RENEWAL OF SUCH LICENSES; PROVIDING A
REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PRO-
VIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the Code of Ordinances of the City of
Baytown is hereby amended by the amendment of Chapter 28,
"Swimming Pools ", by the amending of subsection 28 -6 (a)
which shall read as follows:
Sec. 28 -6. Public swimming pool license terms; fees;
transferability.
(a) Licenses shall be valid for a period of one (1)
year beginning on March 1 of each year and shall be re-
newable annually during the month of February. The
license fee and annual license renewal shall be the sum
of twenty dollars ($20.00). License fees for licenses
issued after September 1 of each license year shall be
prorated upon the basis of one -half of the original
renewal fee or $10.00. All license fees shall be
nonrefundable.
Section 2: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided, however, that such repeal shall be only
to the extent of such inconsistency and in all other respects
this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this
ordinance.
Section 3: If any provision, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, small for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their
application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be
severable.

Section 4: This ordinance shall take effect from and
after its passage.
