Ordinance No. 3,22710017 -3 ORDINANCE NO. 3227 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS; ACCEPTING THE BID OF STEWART & STEVENSON FOR THE PURCHASE OF A DIESEL ENGINE FOR A CITY GARBAGE TRUCK; AUTHORIZING THE PAYMENT OF ($6,800.00) DOLLARS WITH REGARD TO SUCH ACCEPTANCE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the diesel engine for a city garbage truck has been rendered unservicable. WHEREAS, the Public Works Director has requested that a new diesel engine be purchased to alleviate this problem, which has created a need for immediate action by the City; and WHEREAS, when it becomes necessary to appropriate money at once to protect the health, safety, and welfare of the citizens of Baytown, or to replace public property in the case of unforseen damage, the requirement of publishing notice and taking competitive bids is not applicable; and WHEREAS, the City Administration has taken informal bids for the costs of the necessary purchase of a diesel engine and Stewart & Stevenson submitted the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council hereby declares and finds that an emergency situation exists; that immediate action is necessary to protect the health, safety and welfare, of the citizens of Baytown, and to replace public property that has been damaged, and that the requirement of formal notice and bids are hereby waived. Section 2: That the bid of Stewart & Stevenson for the purchase of a diesel. engine is hereby accepted and payment of the sum of Six Thousand Eight Hundred & No /100 ($6,800.00) Dollars is hereby authorized_ • 10917 -3a Section 3: This ordinance shall take effect from and after its passage.
