Ordinance No. 3,22610917 -2 ORDINANCE NO. 3226 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS; ACCEPTING THE BID OF CHANNEL CONSTRUCTION CO. FOR THE SLIPLINING OF THE SANITARY SEWER LINE ON KILGORE ROAD; AUTHORIZING THE PAYMENT OF TEN THOUSAND EIGHT HUNDRED FIFTY SIX & 25/100 (.$10,856.25) DOLLARS WITH REGARD TO SUCH ACCEPTANCE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the 7 inch sanitary sewer line on Kilgore Road is 425 feet in length, and has several caveins and is missing much of the old concrete pipe. WHEREAS, the City Engineer has requested that sliplining be done to alleviate this problem, which has created a need for immediate action by the City; and WHEREAS, when it becomes necessary to appropriate money at once to protect the health, safety, and welfare of the citizens of Baytown, the requirement of publishing notice and taking competitive bids is not applicable; and WHEREAS, the City Administration has taken informal bids for the costs of the necessary sliplining, and Channel Construction submitted the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section l: That the City Council hereby declares and finds that an emergency situation exists; that immediate action is necessary to protect the health, safety and welfare of the citizens of Baytown, and that the requirement of formal notice and bids are hereby waived. Section 2: That the bid of Channel. Construction for the sliplining is hereby accepted and payment of the sum of TEN THOUSAND EIGHT HUNDRED FIFTY SIX & 25/100 ($10,856.25) Dollars is hereby authorized.
