ORDINANCE NO. 3220
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
TEXAS, AMENDING CHAPTER 7, "BUILDING ", SECTION 7 -4.1,
BUILDING CODE -- AMENDMENTS, BY AMENDING REQUIREMENTS FOR
HANDICAPPED PARKING; PROVIDING A REPEALING CLAUSE; CON-
TAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That Section 7 -4.1, Building Code -- Amendments,
of the Code of Ordinances of the City of Baytown is hereby
amended by the repeal of the amendment to section 508.3(x)
as presently constituted and by the adoption of a new section
508.3(x) that shall read as follows:
Sec. 7 -4.1. Same- Amendments.
Section 508.3(a) "Access to Buildings" is hereby
amended by the repeal of subsection (2) of that section
as presently constituted and by the adoption of a new
subsection 508.3(x) (2) that shall read as follows:
508.03 - Requirements
(a) Access to Buildings
(2) If a person who owns or controls property
used for parking designates one or more parking
spaces or a parking area for the exclusive use
of vehicles transporting temporarily or perman-
ently disabled persons, such spaces shall be
designated as provided by state law, and shall
be on level ground. Parking spaces for the
physically handicapped shall be located as close
as possible to elevators, ramps, walkways and
entrances_ Parking spaces should be located
so that physically handicapped persons are not
compelled to wheel or to walk behind parked cars
to reach entrances, ramps, walkways and elevators.
Section 2: Ail. ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided, however, that such repeal shall. be only
to the extent of such inconsistency and in x.11 other respects
this ordinance shall be cumulative or other ordinances
regulating and governing the subject matter covered by
this ordinance.
Section 3: If an provisions, section, exception, sub-
section, paragraph, sentence, clause or phrase of this ordinance

or the application of same to any person or set of circum-
stances, shall for any reason be held unconstitutional, void
or invalid, such invalidity shall not affect the validity
of the remaining provisions of this ordinance or their appli-
cation to other persons or sets of circumstances and to this
end all provisions of this ordinance are declared to be
severable.
Section 4: This ordinance shall take effect from and
after its passage by the City Council of the City of Baytown.
