ORDINANCE NO. 3218
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS;
AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY
CLERK TO ENTER INTO A CONTRACT WITH LAYNE TEXAS
COMPANY TO REPAIR A CITY WATER WELL; AUTHORIZING THE
PAYMENT OF THE SUDI OF EIGHTEEN THOUSAND FIVE HUNDRED &
NO /100 ($18,500.00) DOLLARS WITH REGARD TO SUCH ACCEPTANCE;
AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, the James Street water well has suffered
damage and is in a state of disrepair; and
WHEREAS, the reworking of the water well so that it may
provide municipal water service is necessary for the preservation
and protection of the health, welfare, and safety of the
citizens of the City of Baytown; and
WHEREAS, considering the above, the City Council of the
City of Baytown deems that an emergency situation exist, and
therefore, the requirements for publishing notice and taking
formal bids does not apply NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That the City Manager and City Clerk of the
City of Baytown are authorized and directed to enter
into a contract with Layne Te „as Conipany to repair the James
Street water well, and the payment of the sum of EIGHTEEN
THOUSAND FIVE HUNDRED & NO /100 (.$x18,500.00) DOLLARS is
hereby authorized.
Section 3: That pursuant to the provisions of TEX.REV_
CIV.STAT_ art. 2368a, the City Manager is hereby granted
general authority to approve any change order involving a
decrease or an increase in costs of Five Thousand and No /100
($5,000.00) Dollars or Less, subject to the provision that
the original contract price may not be increased by more
than twenty -five (25) percent or decreased by more than
twenty -five (25) percent without the consent of the contractor
to such decrease.

Section 4: This ordinance shall take effect from and
after its passage.
