Ordinance No. 3,20010723 -5 ORDINANCE NO. 3200 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN ADDING CERTAIN PROPERTY TO COUNCIL DISTRICT NO. 5; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. WHEREAS, Section 17 (1) of the Charter of the City of Baytown provides that the City Council shall redistrict the City if the growth of the City justifies; and WHEREAS, it is necessary to include the newly annexed territory described herein in a Council District; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: Council District No. 5 is hereby redistricted by the addition of certain property which is described as follows: BEING a 35.63 acre tract of land out of the Christian Smith Survey Abstract No. A -69, the J. W. Singleton Survey A-709, and the D. M. McFadden Survey A -591, Harris County, Texas and being more particularly described as follows: BEGINNING at the point of intersection of the Southeast corner of Chaparral Village, Section One with the North line of the existing corporate limits of the City of Baytown, said point being North 27 degrees 27 minutes 23 seconds East a distance of 247.42 feet from the North right -of -way line of ?!Massey- Tompkins Road; THENCE North 27 degrees 27 minutes 23 seconds East, continuing along the westerly line of Harris County Flood Control 40 foot easement a distance of 485.84 feet to a point at the most easterly corner of Chaparral Village. THENCE North 11 degrees 7 minutes 36 seconds West a distance of 899.70 feet to the point of intersection of the Southwest corner of Chaparral Village, Section Two with the Easterly boundary line of Chaparral Village, Section One; THENCE South 87 degrees 27 minutes 40 seconds East a distance of 663.75 feet to the point of intersection of the Southeast corner of Chaparral Village, Section Two with the easterly line of the Harris County Flood Control 40 foot easement; THENCE North 27 degrees 27 minutes 23 seconds East along the easterly line of the Harris County Flood Control 40 foot easement a distance of 743.54 feet to a point at the most easterly corner of Chaparral Village Section Two; 10723 -5a THENCE in a Southeasterly direction a distance of approximately 100 feet to the southeasterly right -of --way line of Southern Pacific Railroad, said point being the northern most Northwest corner of the proposed Raven Way Subdivision; THENCE North 79 degrees 47 minutes 01 seconds East with the North line of said Subdivision a distance of 59.85 feet to the Northeast corner of said Subdivision; THENCE South 10 degrees 50 minutes 03 seconds East with the most easterly line of said Subdivision a distance of 736.08 feet to a Southeast corner of said Subdivision; Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect from and after its passage and the City Clerk is hereby directed to publish the caption of this ordinance at least once in the official newspaper of the City of Baytown.
