Ordinance No. 3,19510709 -5 ORDINANCE NO. 3195 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS; ACCEPTING THE BID OF GLENLEN PAVING FOR THE CONSTRUCTION OF A CONCRETE LINED CHANNEL; AUTHORIZING THE PAYMENT OF FIVE THOUSAND TWO HUNDRED FIFTY & NO 1100'S ($5,250.00) WITH REGARD TO SUCH ACCEPTANCE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, citizens along Goose Creek Drive and Arrowhead Drive have experienced flooding due to inadequate drainage at the intersection of the two streets; and WHEREAS, the City Engineer has determined that a concrete lined channel will alleviate the flooding, and such con- struction needs to be finished prior to the next rainfall, which creates a need for immediate action by the City; and WHEREAS, when it becomes necessary to appropriate money at once to protect the health, safety, and welfare of the citizens of Baytown, the requirement of publishing notice and taking competitive bids is not applicable; and WHEREAS, the City Administration has taken informal bids for the costs of the necessary work, and GLENLEN PAVING submitted the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council hereby declares and finds that an emergency situation exists; that immediate action is necessary to protect the health, safety, and welfare of the citizens of Baytown, and to prevent flood damage resulting from the lack of drainage at the area around the intersection of Goose Creek Drive with Arrowhead Drive; and that the requirement for formal notice and bids are hereby waived. Section 2: That the bid of GLENLEN PAVING for the construction of a concrete channel off Goose Creek Drive is hereby accepted, and payment of the sum of FIVE THOUSAND TWO HUNDRED FIFTY & N011001S ($5,250.00) is hereby authorized. 10709 -5a Section 3: This ordinance shall take effect from and after its passage.
