Ordinance No. 3,18310625 -3 ORDINANCE NO. 3183 AN ORDINANCE ACCEPTING THE BID OF DAVID WIGHT CON- STRUCTION COMPANY, INC., FOR THE GARTH ROAD WATER AND SEWER LINE EXTENSION AND AUTHORIZING THE PAYMENT BY THE CITY OF BAYTOWN OF THE SUM OF ONE HUNDRED ELEVEN THOUSAND SEVEN HUNDRED SIXTY & 50/100 ($111,760.50) DOLLARS. WHEREAS, the City Council of the City of Baytown did authorize Langford Engineering, Inc., Consulting Engineers for the City of Baytown to advertise for bids for the con- struction of the Garth Road Water and Sewer Line Extensions to be received June 17, 1981; and WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was published pursuant to the provisions of TEX.REV.CIV.STAT. art. 2368x; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 a.m., June 17, 1981, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown hereby accepts the bid of DAVID WIGHT CONSTRUCTION COMPANY, INC., according to the plans and specifications set forth by the City's Consulting Engineers for the sum of ONE HUNDRED ELEVEN THOUSAND SEVEN HUNDRED SIXTY & 50/100 ($111,760.50) DOLLARS, and the Mayor and City Clerk of the City of Baytown are hereby authorized and directed to execute and attest to a contract with DAVID WIGHT CONSTRUCTION COMPANY INC., for the construction of the Garth Road Water and Sewer Line Extensions containing the plans, specifications, and requirements of the City's Constulting Engineers and appropriate bond and drawn provisions in accordance with the provisions of TEX.REV. CIV.STAT. art. 5160. 10625 -3a Section 2: That the award of this Contract is contingent upon the receipt of $71,746.00 from Texas Southwest Developers as the developers share of the cost of these extensions. Section 3: That pursuant to the provisions of TEX.REV. CIV.STAT. art 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, provided that the original contract price may not be increased by more than twenty -five (2570) per cent or decreased by more than twenty -five (25%) per cent without the consent of the contractor of such decrease. Section 4: This ordinance shall take effect from and after it passage.
