Ordinance No. 3,170S i 10611 -1 ORDINANCE NO. 3170 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF TIERRA DEL ORO, SECTIONS 2 AND 3 SUBDIVI- SIONS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. WHEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described property, to -wit: BEING a 38.1645 acre tract of land out of the christian Smith Survey Abstract No. 69, Harris County, Texas and being more particularly described as follows: BEGINNING at the Northwest corner of Tierra del Oro, Section One as per plat recorded in Volume 298, Page 77 of the Harris County Flap Records and being the Southeast corner of Lot 11, Block 5, Cedar Bayou Estates, said corner being on the existing city limit line of the City of Baytown; THENCE South 09 degrees the existing city limit line of Tierra del Oro, west corner of Whisperi recorded in Volume 275, Records; 29 minutes 06 seconds East along line, said line being the West Section One, and being the north - ng Pines, Section Four, as per plat Page 145 of the Harris County Map THENCE South 09 degrees 13 minutes 36 seconds East along the existing city limit line, said line being the West line of Whispering Pines, Section Four, a distance of 810.00 feet to the Southwest corner of said Whispering Pines, Section Four, also being in the North line of Whispering Pines, Section One, as per plat recorded in Volume 194, Page 63 of the Harris County Map Records; THENCE South 80 degrees 14 minutes 08 seconds West along the existing city limit line, said line being the North line of said Whispering Pines, Section One, a distance of 1,198.83 feet to the Northwest corner of said Whispering Pines, Section One, also being situated in the East right - of -way line of Raccoon Road; THENCE North 09 degrees 24 minutes 06 seconds West with the East right -of -way line of Raccoon Road a distance of 1,387.67 feet to the Northwest corner of this tract, also being the Southwest corner of Lot 11, Block 5 of Cedar Bayou Estates; THENCE North 80 degrees 29 minutes 54 seconds East with the South line of said Lot 11, Block 5, Cedar Bayou Estates a distance of 1,200.45 feet to the POINT OF BEGINNING, enclosing a tract of land containing 38.1645 acres of land more or less. ( TIERRA DEL ORO, SECTIONS 2 AND 3) was held at 7:00 p.m. in City Hall of the City of May, 1981, which date is than ten (10) days prior proceedings; and WHEREAS, notice of 10611 -1a the city Council Chamber of the Baytown, Texas, on the 28 th day of not more than twenty (20) nor less to the institution of annexation such public hearing was published in a newspaper having general circulation in the City of Baytown, Texas, and in the above described territory on the 15th day of May, 1981, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the total corporate area of the City of Baytown, Texas on the 1st day of January 1981, was 28.79 square miles; and WHEREAS, the population of the City of Baytown, Texas is approximately 56,650 inhabitants; and WHEREAS, the above described territory lies within the extraterritorial jurisdiction of the City of Baytown, Texas; and WHEREAS, the above described territory lies adjacent to and adjoins the City of Baytown, Texas; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the following described land and territory lying adjacent to and adjoining the City of Baytown, Texas, is hereby added and annexed to the City of Baytown, Texas, and shall hereinafter be included within the boundary limits of the City of Baytown, Texas, and present boundary limits of such City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Baytown, Texas,to -wit: 10611 -1b BEING a 38.1645 acre tract of land out of the Christian Smith Survey Abstract No. 69, Harris County, Texas and being more particularly described as follows: BEGINNING at the Northwest corner of Tierra del Oro, Section One as per plat recorded in Volume 298, Page 77 of the Harris County Map Records and being the Southeast corner of Lot 11, Block 5, Cedar Bayou Estates, said corner being on the existing city limit line of the City of Baytown; THENCE South 09 degrees 29 minutes 06 seconds East along the existing city limit line, said line being the West line of Tierra del Oro, Section One, and being the northwest corner of Whispering Pines, Section Four, as per plat recorded in Volume 275, Page 145 of the Harris County Map Records; THENCE South 09 degrees 13 minutes 36 seconds East along the existing city limit line, said line being be West line of Whispering Pines, Section Four, a distance of 810.00 feet to the Southwest corner of said Whispering Pines, Section Four, also being in the North line of Whispering Pines, Section One, as per plat recorded in Volume 194, Page 63 of the Harris County Map Records; THENCE South 80 degrees 14 minutes 08 seconds West along the existing city limit line, said line being the North line of said Whispering Pines, Section One, a distance of 1,198.83 feet to the Northwest corner of said Whispering Pines, Section One, also being situated in the East right -of -way line of Raccoon Road; THENCE North 09 degrees 24 minutes 06 seconds West with the East right -of -way line of Raccoon Road a distance of 1,387.67 feet to the Northwest corner of this tract, also being the Southwest corner of Lot 11, Block 5 of Cedar Bayou Estates; THENCE North 80 degrees 29 minutes 54 seconds East with the South line of said Lot 11, Block 5, Cedar Bayou Es- tates a distance of 1,200.45 feet to the POINT OF BEGINNING, enclosing a tract of land containing 38.1645 acres of land, more or less. Section 2: The above described territory and the area so annexed shall be a part of the City of Baytown, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, and regulations of the City of Baytown, Texas. 10611 -1c Section 3: This ordinance shall be published and passed in the manner provided in Article 1, Section 9 of the Charter of the City of Baytown, Texas.
