ORDINANCE NO. 3160
AN ORDINANCE AWARDING THE CONTRACT FOR A COMMUNITY
DEVELOPMENT REHABILITATION PROJECT 80 -01 -01 TO C.M.S.
CONSTRUCTION FOR THE SUM OF FIVE THOUSAND SIX HUNDRED
EIGHTY EIGHT & N01100 ($5,688.00) DOLLARS.
WHEREAS, the City of Baytown did advertise for bids for
Community Development Program Rehabilitation Project 80 -01 -01
to be received May 6, 1981; and
WHEREAS, notice to bidders as to the time and place,
when and where the contract would be let was published pur-
suant to provisions of Section 74 of the Charter of the City
of Baytown; and
WHEREAS, all bids were opened and publicly read at the
Community Development Office at 10:00 a.m., Wednesday May 6,
1981, as per published notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the City Council of the City of Baytown
hereby accepts the bid of C.M.S. CONSTRUCTION for the sum of
FIVE THOUSAND SIX HUNDRED EIGHTY EIGHT & No /100 ($5,688.00)
Dollars, and the City Manager and City Clerk of the City are
hereby authorized and directed to execute and attest to a
contract with C.M.S. CONSTRUCTION for Community Development
Rehabilitation Project 80 -01 -01 being the repair and rehabilitation
of 1804 W. Humble, said contract providing that no money
will be paid to said contractor until completion and acceptance
of the work by the City.
Section 2: That pursuant to the provisions of TEX.
REV.CIV.STAT. art. 2368a, the City Manager is hereby granted
general authority to approve any change order involving a
decrease or an increase in costs of Five Thousand and No /100
($5,000.00) Dollars or less, provided that the original con-
tract price may not be increased by more than ten (100)
percent or decreased by more than twenty -five (250) percent
without the consent of the contractor to such decrease.

Section 3: This ordinance shall take effect from and
after its passage.
