Ordinance No. 14,114ORDINANCE NO. 14,114 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT OF THREE HUNDRED EIGHTY-SIX THOUSAND NINE HUNDRED FORTY-TWO AND NO. 100 DOLLARS ($386,942.00) TO NW BEND BOATS, LLC, THROUGH THE UNITED STATES GENERAL SERVICES ADMINISTRATION'S COOPERATIVE PURCHASING PROGRAM, FOR THE PURCHASE OF ONE (1) 32' CBRNE TERRORISM RESPONSE WATERCRAFT FROM NW BEND BOATS, LLC, FOR THE BAYTOWN FIRE DEPARTMENT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. **************************************************************************************** WHEREAS, the Local Preparedness Acquisition Act (P.L. 110-248) amended the Federal Property and Administrative Services Act to authorize the use of Federal Supply Schedule 71 contracts by state and local entities, such as the City of Baytown, under the United States General Services Administration's Cooperative Purchasing Program as an alternate purchasing method satisfying the competitive bidding obligations; and WHEREAS, the purchase of one (1) 32' CBRNE terrorism response watercraft from NW Bend Boats, LLC, for the Baytown Fire Department may be purchased by the City through the GSA Cooperative Purchasing Program; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby authorizes the payment of THREE HUNDRED EIGHTY-SIX THOUSAND NINE HUNDRED FORTY-TWO AND NO100 DOLLARS ($386,942.00) to NW Bend Boats, LLC, for the purchase of one (1) 32' CBRNE terrorism response watercraft from NW Bend Boats, LLC, for the Baytown Fire Department. Section 2: That the City Council of the City of Baytown hereby authorizes the payment of TWELVE THOUSAND FOUR HUNDRED SIXTY-FIVE AND NO!100 DOLLARS ($12,465.00) to NW Bend Boats, LLC, for purchase of one (1) 32' CBRNE terrorism response watercraft authorized in Section 1 hereinabove. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO:' 100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
