Ordinance No. 3,121and 10409 -3 ORDINANCE NO. 3121 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, PROVIDING THAT A PORTION OF BELA AVENUE BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE QUITCLAIMING OF PART OF THE CITY'S INTEREST IN SAID LAND; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, Bela Avenue is a dedicated public street; WHEREAS a public need for such street no longer exists; WHEREAS, Mike McCoy, Ed Shackleford and J. C. Harrison are the abutting land owners to that portion of Bela Avenue and have made application that same be discontinued, closed, and abandoned as a public street; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: The property to be abandoned is described as follows: COMMENCING at the iron pin at the northeast corner of Lot 1, Block 1; THENCE south 80 degrees 30 minutes west for a distance of 100.10' to the westerly boundary line of the Outlawn Terrace Addition; THENCE north 10 degrees 04 minutes west along the west boundary line of Outlawn Terrace Addition for a distance of 25.00' to a point being the northwestern corner of the Outlawn Terrace Addition; THENCE north 80 degrees 30 minutes east for a distance of 100.20' to a point for a corner; THENCE south 09 degrees 30 minutes east for a distance of 25.00' to the point or place of beginning; said tract containing 0.0574 acres of land, more or less. Section 2: That that portion of Bela Avenue as described above is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever. Section 3: That the interest or interests of the City and /or public in the above described portion of said street (and as shown in Exhibit "A" attached hereto) is hereby 10409 --3a quitclaimed to the adjacent owners for and in consideration of FOUR HUNDRED THIRTY & No /100 (.$430.00) Dollars. Section 4: That the Mayor and City Clerk are hereby authorized to execute such instruments, if any, necessary for such abandonment. Section 5: That this ordinance is to become effective from and after its passage by the City Council of the City of Baytown.
