Ordinance No. 3,11810326 -8 ORDINANCE NO. 3118 AN ORDINANCE REPEALING ORDINANCE NO. 3105 WHICH HAD AWARDED HOUSING REHABILITATION CONTRACT NO. 79 -03 -16 TO EDDIE MARROQUIN AND AWARDING HOUSING REHABILITATION CONTRACT NO. 79 -03 -16 TO C & J PAINTING FOR THE SUM OF FIVE THOUSAND SIX HUNDRED SIXTEEN & 33/100 ($5,616.33) DOLLARS. WHEREAS, the City of Baytown awarded Housing Rehabilita- tion Contract No. 79 -03 -16 for repairs to 1132 Stowe by Ordinance No. 3105 passed on March 12, 1981; and WHEREAS, it has come to the attention of the City Council that Eddie Marroquin's bid of Seven Thousand Nine Hundred Sixty Eight & 35/100 ($7,968.35) is not the best and lowest bid on Housing Rehabilitation Project #79 -03 -16 and that C & J Painting's bid of FIVE THOUSAND SIX HUNDRED SIXTEEN & 33/100 ($5,616.33) Dollars is the best and lowest bid; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That Ordinance 3105, awarding Project No. 79 -03 -16 to Eddie Marroquin is hereby REPEALED and declared of no further force and effect. Section 2: That the City Council of the City of Baytown hereby accepts the bid of C & J Painting for the sum of FIVE THOUSAND SIX HUNDRED SIXTEEN & 33/100 ($5,616.33) Dollars, and the City Manager and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with C & J Painting for Community Development Rehabilitation Project No. 79 -03 -16 being the repair and rehabilitation of 1132 Stowe, said contract providing that no money will be paid to the contractor until completion and acceptance of the work by the City. Section 3: That pursuant of the provisions of TEX.REV. CIV.STAT. art 2368a, the City Manager is hereby granted general authority to approve any change order involving a 10326 -8a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, provided that the original con- tract price may not be increased by more than ten (10 %) per cent or decreased by more than twenty -five (250) percent without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect from and after its passage.
