Ordinance No. 3,00301023 -7 ORDINANCE NO. 3003 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND ATTEST TO AGREEMENTS WITH HARRIS COUNTY COMMUNITY DEVELOPMENT AGENCY AND EXXON PIPELINE COMPANY FOR THE RELOCATION OF A PIPELINE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown, Texas, hereby approves the contract with the Harris County Community Development Agency providing responsibility for the payment of the cost of relocating a private pipeline and authorizes and directs the Mayor and City Clerk of the City of Baytown to execute and attest to said contract. A copy of said contract is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2: That the City Council of the City of Baytown, Texas, hereby approves the agreement with Exxon Pipeline Company for the relocation of a pipeline as part of the proposed improvement to Dorris Street and authorizes and directs the Mayor and City Clerk to execute and attest to said agreement. A copy of said agreement is attached hereto, marked Exhibit "B," and made a part hereof for all intents and purposes. Section 3: This ordinance shall take effect from and after its passage. STRONG, City torney 01023 -7a E X H I B I T "A" 01023 -7b A G R E E M E N T THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF HARRIS 0 THIS AGREEMENT, made and entered into by and between HARRIS COUNTY COMMUNITY DEVELOPMENT AGENCY, an agency of Harris County, hereinafter referred to as "Agency," and the CITY OF BAYTOWN, hereinafter called "City," a municipal corporation under the laws of the State of Texas, acting herein by and through its Mayor,. thereunto duly authorized. W I T N E S S E T H: WHEREAS, said Agency is making improvements to Dorris Street, a public street within the City of Baytown, as a part of a community development project; and WHEREAS, said improvements necessitate the relocation of a private pipeline located within right -of --way belonging to the City; and WHEREAS, said Agency and City have determined that it would be in the best interest of said City and said Agency and of the citizens and inhabitants of the City of Baytown and Harris County to make the proposed improvement of Dorris Street, including the relocation of the private pipeline; NOW THEREFORE, the City and Agency agree as follows: I. The City and Agency agree that the City is to contract with Exxon Pipeline Company to relocate a pipeline owned by Exxon Pipeline Company. Such relocation shall be done according to the terms of an agreement proposed by Exxon Pipeline Company, a copy of which is attached hereto as Exhibit "A," and which shall be referred to as the "Contract." 01023 -7c II . The parties agree that the Agency shall reimburse the City for 100; of the City's cost under the terms of the Contract. It is estimated that the cost of the proposed work will be Forty -Three Thousand One Hundred Sixty and No /100 ($43,160.00) Dollars, but it is understood by the City and the Agency that the final cost could be more or less than the estimated figure, and that the Agency will reimburse the City for 1000 of the actual cost incurred due to the relocation of the pipeline. III. Before the City can agree to any change in the work as shown in the Contract, such change shall be submitted to the Agency for the Agency's approval. The Agency may make such minor changes in the material to be used and the work to be done as it deems necessary or desirable, but shall reimburse the City for any additional charge made to the City by Exxon Pipeline Company resulting or arising from such changes. IV. Within ten (10) days of execution of this Agreement, the Agency will pay to the City Forty -Three Thousand One Hundred Sixty and No /100 ($43,160.00) Dollars as the estimated amount the City will be required to pay to Exxon Pipeline Company under the Contract. After completion of the pipeline relocation, if the actual cost is less than the above amount, the City will reimburse the difference to the Agency within thirty (30) days of the determination of the final cost.
