Oct. 30, 1980 ORDINANCE NO. 3002 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN ADDING CERTAIN PROPERTY TO COUNCIL DISTRICT NO- -5 ; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. WHEREAS, Section 17 {1} of the Charter of the City of Baytown provides that the City Council shall redistrict the City if the growth of the City justifies; and WHEREAS, it is necessary to include the newly annexed territory described herein in a Council District; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: Council District No. 5 is hereby redistricted by the addition of certain property which is described as follows: All that certain lot, block, or tract of land situated in Harris County, Texas, in the J. W. Singleton Survey, Abstract No. 709 and being more fully described as follows: BEGINNING at a point 200' North of Massey Tompkins Road and 190' East of North Main Street, an ell corner of the existing city limits of the City of Baytown; THENCE, North 000 34' 00" East along the existing city limit line a distance of approximately 2,118.56' more or less to a point for a corner, said point being 190' East of North Main Street; THENCE, North 790 24' 09" East a distance of 2,517.03' more or less to a point for a corner, said point being in the East boundary line of Barkuloo Road, a 60' road; THENCE, South 110 30' 48" East with the Chaparral Village, Section Five and the way line of Barkuloo Road a distance of less to a point for a corner, said poin most Westerly South corner of Chaparral Five; West line of East right -of- 262' more or t being the Village, Section THENCE, North 790 52' 12" East with the South line of Chaparral Village, Section Five a distance of 687.03' more or less to a point for a corner, said point being situated in the West line of Chaparral Village, Section Three and said line also being the city limits line of the City of Baytown; THENCE, South 110 34' 29" East with the West boundary line of Chaparral Village, Section Three a distance of 1,270' more or less to a point for a corner, said point being the Southwest corner of Chaparral Village, Section Three; 01023 -6a THENCE, North 800 19' 18" East along the South boundary line of Chaparral Village, Section Three a distance of 274.84' more or less to a point for a corner, said point also being the Northwest corner of the C. A. Wright Subdivision; THENCE, South 110 05' 28" East along the West boundary line of the C. A. Wright Subdivision a distance of 592' more or less to a point for a corner, said point being 200' North 110 05' 28" West of the North boundary line of Massey Tompkins Road; THENCE, South 800 241 30" West along the existing Baytown city limits line a distance of approximately 2,244.691 more or less to a point for a corner, said point being in the East boundary line of a five acre tract of land known as Tract C -9, City of Baytown Tax Map; THENCE, North 110 08' 00" West along the existing city limit line and along the East boundary line of said Tract C -9 a distance of approximately 520' to a point for a corner said point being the Northeast corner of said Tract C -9; THENCE, South 800 24' 30" West along the existing city limit line and along the North boundary line of said Tract C -9 and Tract C -8, a 4.6536 acre tract, a distance of approximately 605' to a point for a corner, said point being the Northwest corner of said Tract C -8; THENCE, South 100 301 00" East along the existing city limit line and with the West boundary line of said Tract C -8 a distance of approximately 520' to a point for a corner, said point being 200' North of Massey Tompkins Road; THENCE, South 800 24' 30" West along the existing city limit line a distance of approximately 1,060' to the point of beginning containing 163 acres of land, more or less. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of -2- 01023 -6a the remaining provisions of this ordinance or their appli- cation to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect from and after its passage and the City Clerk is hereby directed to publish the caption of this ordinance at least once in the official newspaper of the City of Baytown.
