Ordinance No. 2,97400925 -3A ORDINANCE NO. 2074 AN ORDINANCE AMENDING CHAPTER 31, "UTILITIES," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN BY AMENDING SECTION 31 -55, WATER TAPPING FEES; AMENDING SECTION 31- 65, SEWER SERVICE CHARGE; AMENDING SECTION 31 -67, SEWER TAPPING FEES; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the Code of Ordinances of the City of Baytown, Texas is hereby amended by the amendment of Chapter 31, "Utilities," Article IV, Water Service, by the repeal of Section 31 -55, Water Tapping Fees, as presently constituted and by substituting in its place a new Section 31--55 which shall read as follows: Sec. 31 -55. Water tapping fees. (a) The following fees shall be assessed and collected by the water billing department for water taps: (1) 3/4 inch water tap . . . . . . . . $250.00 (2) 1 inch water tap . . . . . . . . . $300.00 Section 2: That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Chapter 31, "Utilities," Article V, Sewer Service, by the repeal of Section 31 -65, Sewer Service Charge, and by the repeal of subsection 31- 67(a), Sewer Tapping Fees, as presently con- stituted, and by the addition of a new Section 31 -65 and a new subsection 31- -67(a) which shall read as follows: Sec. 31 -65. Sewer service charge. A. Rate Schedule 1. Minimum monthly rate . . . . . . . . . $4.50 2. Standard rate (per 1,000 gallons in excess of minimum monthly) . . . . . . . . . . . $0.85 00925 -3Aa B. Residential dwelling units. (1) Individually metered for water consumption: Each residential dwelling unit individually metered and billed for the consumption of water shall be charged for and owe each month a sewer service charge based upon the consumption of water attributed to it as determined by the provisions of this Code relating to water charges, applied to the following usage and the rate schedule for sewer service. Gallons of water used per month First 2,000 gallons Next 8,000 gallons, per 1,000 gallons Thereafter Sewer service rate to be charged Minimum monthly rate Standard rate No charge (2) Jointly metered for water consumption: Multi - family dwelling unit projects not individually metered for water shall be charged for and owe each month a sanitary sewer charge based upon consumption of water attributed to it as determined by the provisions of the Code relating to water charges applied to the following usage and the rate schedule for sewer service: Gallons of water Sewer service rate used for month to be charged First 2,000 gallons times the number of occupied units Excess of 2,000 gallons times the number of occupied units, per 1,000 gallons Minimum monthly times the number units Standard rate rate of occupied (a) Occupied units in the project shall be taken to be the total number of units in the project unless the project manager shall report to the city on the form provided in Annex "A" the actual number of occupied units as of the first day of the current month. This report must be received by the city no later than the 10th day of the current month. C. Commercial units. Each commercial unit shall be charged for and owe each month a sanitary sewer service charge based upon the consumption of water attributed to it, applied to the following usage and the rate schedule for sewer service: Gallons of water used per month First 2,000 gallons Thereafter, per 1,000 gallons -2- Sewer service rate to be charged Minimum monthly rate Standard rate 00925 -3Ab D. Mobile home parks. Mobile home parks shall be charged for and owe each a sanitary sewer service charge based upon consumption of water attributed to it as determined by the provisions of this Code relating to water charges applied to the following usage and the rate schedule for sewer service: Gallons of water used per month First 2,000 gallons times the number of occupied spaces Excess of 2,000 gallons times the number of occupied spaces, per 1,000 gallons Sewer service rate to be charged Minimum monthly rate times the number of occupied spaces Standard rate (a) Occupied spaces in the project shall be taken to be the total number of spaces in the project, unless the project manager shall report to the city on the form provided in Annex "A" the actual number of occupied spaces. "ANNEX A" Utility Office Manager City of Baytown P. 0. Box 424 Baytown, Texas 77520 Dear Sir: I hereby certify that I am the owner (or manager) of a multi - family dwelling project located at Street, Baytown, Texas. This project is known as the (indicate the project's name, if applicable). I hereby certify that the aforementioned project has (number) units. I further certify that as of the first day of the current calendar month, there were (number) occupied units in the project, and that there were (number) unoccupied units. I understand that the information hereby given is to be used by the City of Baytown in computing the current month's sewer service charge for this project. I also understand that this information must be received by the City of Baytown no later than the 10th day of each month in order to be considered. I further understand that the information hereby given may be verified at any time upon the request of the Utility Office Manager of the City of Baytown. (Signature) Manager or Owner -3- 00925 -3Ac Sec. 31 -67. Sewer tapping fees. (a) The water billing department shall assess and collect a one hundred seventy -five dollars($175.00)sewer tap fee for each and every 4 -inch sewer tap. All other types (6 inches and larger) and other special connections shall be made at estimated actual cost as determined by the Utility Office Manager with consultation of the Director of Public Works or his designee. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: if any provision, section, exception, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the valid- ity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect from and after ten (10) days from its passage by the City Council, except for the provisions of this ordinance relating to sewer service charges (Sec. 31 -65 as amended herein) which shall become effective with billings showing service for the month of October, 1980.
