Ordinance No. 2,97000911 --7 ORDINANCE NO. 2970 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AMENDING SECTION 7 -5.1 "MINIMUM PROPERTY STANDARDS FOR ONE AND TWO LIVING UNITS -- AMENDMENTS," BY DELETING LOT COVERAGE STANDARDS; ESTABLISHING MINIMUM DISTANCES BETWEEN STRUCTURES AND PROPERTY LINES; REQUIRING THE USE OF SMOKE DETECTORS; DELETING MECHANICAL, ELECTRICAL, AND PLUMBING STANDARDS; REPEALING ORDINANCES INCONSIS- TENT HEREWITH; CONTAINING A SAVINGS CLAUSE; AND PRO - VIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That Section 7 -5.1 of the Code of Ordinances of the City of Baytown is hereby amended to read as follows: Sec. 7 -5.1. Minimum property standards for one and two living units -- Amendments. (a) Section 502 - Lot coverage, shall not be applicable. (b) Section 503 -2.1 is hereby amended by the repeal of that section as presently constituted and by the adoption of a new section 503 -2.1 which shall read as follows: Section 503 -2.1. Minimum distance from front building N line to property line, at any point, 15 feet. The minimum distance from rear building line to rear property line, at any point, 5 feet. A carport which is open on three sides (the side nearest the front property line and the two adjacent sides, or if located on a corner lot and entering the secondary street, the side nearest to the secondary street and the two adjacent sides) may have an overhang extending to the front property line (or side property line in the case of a carport on a corner lot entering on the secondary street) with no structural post installed closer than 3 feet from the property line. (c) Section 6.08. "Fire protection and safety" is amended by the addition of Section 608.3.6 which shall read as follows: Section 6.08.3.6. Smoke Dectectors. Each sleeping area shall be provided with a minimum of one (1) UL approved listed and labeled smoke detector installed adjacent to the sleeping area. (d) Sections 1000 through 1103.9.2 providing for mechanical, plumbing, and electrical standards shall not be applicable, Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only 00911- 7a to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the valid- ity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable.
