Ordinance No. 2,96900911 -6 ORDINANCE NO. 2969 AN ORDINANCE AMENDING CHAPTER 7, "BUILDINGS," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN BY ADOPTING THE 1979 EDITION OF THE STANDARD BUILDING CODE; AMEND- ING VARIOUS SECTIONS OF SAID CODE; PROVIDING A RE- PEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PRO - PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section l: That Section 7 -4 of the Code of Ordinances of the City of Baytown is hereby amended to read as follows: Sec. 7 -4. Building code -- Adopted by reference. Except as hereinafter provided, the Standard Building Code by the Southern Building Code Congress, 1979 Edition, and all amendments thereto, heretofore or hereafter adopted, of which not less than three (3) copies are to be on file in the office of the city clerk of the City of Baytown and the same is hereby adopted and incorporated as fully as if set forth at length herein, and from the date on which this section shall take effect, the provisions therein shall be controlling in the construction, alteration, equipment, and removal of buildings and structures for industrial and commercial construction within the city limits of the City of Baytown. Section 2: That Section 7 -4.1 of the Code of Ordinances of the City of Baytown is hereby amended by the addition of the following exceptions that shall read as follows: Sec. 7 -4.1. Same -- Amendments. Section 706.6. "Wood Shingles and Shakes" is hereby amended by the repeal of same as presently constituted and by the adoption of a new Section 706.6 that shall read as follows: Section 706.6. "Wood Shingles and Shakes." Wood shingles or shakes shall not be used to roof any new construction. Section 2002.1. "Toilet Facilities" is hereby amended by the repeal of same as presently constituted and by the adoption of a new Section 2002.1 that shall read as follows: Section 2002.1. "Toilet Facilities." Every building or portion thereof where persons are employed shall be provided with at least one toilet. Every building and each subdivision thereof where both sexes are employed shall be provided with access to at least two toilets, except where there are five (5) or less employees on any one shift. 00911 -Ba Every building and each subdivision thereof where both sexes are employed and open to the public shall be provided with access to public sanitary facilities for each sex (number of fixtures as prescribed by the Plumbing Code). In buildings which are open to the public, said sanitary facilities shall be made readily accessible to the public and all required facilities shall be free to the public. "Pay toilets" may be installed in public facilities on fixtures which are in excess of the required number as prescribed by the Plumbing Code. Exception: In single family living units, there shall be minimum fixtures (as set forth by the Plumbing Code) and connected to an approved disposal system. Section 3: All ordinances or parts of ordinances in- consistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable.
