Ordinance No. 2,95900826 -2 ORDINANCE NO. 2959 AN ORDINANCE AMENDING CHAPTER 2, "ADMINISTRATION," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN TO RE- STRUCTURE MEMBERSHIP OF THE TRAFFIC COMMISSION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section l: That Chapter 2, "Administration," of the Code of Ordinances of the City of Baytown is hereby amended by the repeal of Sec. 2 -63, Traffic Commission - Commission Established; Membership, as presently constituted and by the adoption of a new Sec. 2--63 that shall read as follows: Sec. 2 -63. Commission Established; Membership; Rules of Procedure. (a) There is hereby established the Baytown Traffic Commission, hereinafter referred to as the commission, which shall consist of five (5) members appointed by the city council. The members of the commission may be removed by the city council with or without cause. (b) Three (3) members of the commission shall be appointed during odd numbered years and two (2) members shall be appointed during even numbered years. Such appointments shall coincide with the terms served by the city council members. (c) The chief of police, city attorney or designee, city engineer, director of traffic and planning, and city manager shall serve as nonvoting ex officio members of the commission. (d) The commission is hereby empowered to establish its own parlimentary procedure; provided that such shall not be in conflict with the laws applicable to the commission or the following: A quorum shall consist of a majority of the voting members of the commission, and approval of any action shall require the affirmative vote of a majority of those present, excluding ex officio members.
