ORDINANCE NO. 2958
AN ORDINANCE AUTHORIZING THE CONVEYANCE OF RIGHT OF WAY
AND PIPELINE EASEMENTS UNDER, UPON, OVER, AND THROUGH
LANDS WHICH THE CITY OF BAYTOWN OWNS; DIRECTING THE
MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO
INSTRUMENTS GRANTING RIGHT OF WAY AND PIPELINE EASEMENTS
TO TEXAS EASTERN TRANSMISSION CORPORATION; AND PROVIDING
FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, Texas Eastern Transmission Corporation is in
need of purchasing right of way and pipeline easements upon,
over, and through three (3) parcels of real property as
shown in Exhibits "A ", "B ", and "C" attached hereto and
owned by the City of Baytown; and
WHEREAS, the City Council of the City of Baytown has
determined that the City's use of the properties in question
will not be impaired by granting said right of way and
pipeline easements; and
WHEREAS, Texas Eastern Transmission Corporation has
offered to pay the sums of $3,775.50, $3,035.00, and $5,991.50,
for a total of $12,802.00 for said right of way and pipeline
easements under, over, and through the properties described
in Exhibits "A", "B ", and "C" respectfully and which the
City of Baytown owns; and
WHEREAS, the City of Baytown has had an independent
appraisal made of said right of way and pipeline easements
and has determined that the offers of Texas Eastern Trans-
mission Corporation are equal to the fair market value of
said right of way and pipeline easements; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS:
Section l: That the City Council of the City of Baytown
for the consideration herein set forth does hereby authorize
the conveyance to Texas Eastern Transmission Corporation of
said right of way and pipeline easements for the construction,
laying, maintenance, operation, alteration, repairing,

removal, changing of size, and replacement of pipelines and
appurtenances thereto under, upon, over, and through certain
properties which the City of Baytown owns and described in
Exhibits "A ", "B ", and "C" which are attached hereto and
made a part hereof for all intents and purposes.
Section 2: That upon receipt of the consideration set
forth herein, the Mayor is hereby authorized and directed to
execute and the City. Clerk to attest to instruments granting
such right of way and pipeline easements.
Section 3: That the City Council hereby authorizes the
acceptance of the sums of $3,775.00, $3,035.00, and $5,991.50,
for a total of $12,802.00 as consideration for said right of
way and pipeline easements described in Exhibits "A ", "B ",
and "C" respectively.
Section 4: This ordinance shall take effect from and
after its passage.

the City Council of the City of Baytown this 26th day

A permanent right -of --way fifty (50) feet in width over and across that
certain tract or parcel of land situated in the John rdcSean Survey A -1017
(G. C. & SF. RR. ), Harris County, Texas. The permanent right -of -way
herein described being 25 feet in width on the westerly side and 25 feet
in width on the easterly side of the follauing centerline:
Eeginnino at a point in the easterly line of the above described tract
of land in the centerline of Goose Creek, said point being located
appraxlmately 1164 feet northerly along said Creek from its intersection
with the centerline of the Lynchburg -Ceder Bayou Road. Said point also
being located 50 feet northwesterly at a right angle from an existing
.18" pipeline;

Thence S120361W, 106 feet to the point of exit in the southerly line of the above
described tract of land in the centerline of Lynchburg - Cedar Bayou Raod.
Said point being located 99.5 feet westerly along said southerly line from its
intersection with the centerline of Goose Creek. The herein described
permanent right -of -way containing 1.35 _acres of land, more or less.
Also a temporary right -of -way 25 feet in width located parallel and adjacent
to the westerly side of the above described permanent right --of -way, said
temporary right --of -way containing 0.68 acre of land, more or less.

length located parallel and adjacent to the westerly side of the above
described temporary right --of-way at Goose Creek and at Lynchburg -
Cedar Payou Road, as shuan in Details "A" and "C ". Said additional
temporary rights --of-way containing 0.14 acre of land, more or less.

A permanent right - -of -tray over and across that certain tract or parcel
of land situate in Harris County, Texas. Said tract of land being
part of the Harvey Whiting League, A -840 of said county and state.
Said permanent right -of --tray being described as follows:
Said permanent right -of -way being the east 20 feet of the above
described tract of land. Said permanent right -of --way containing
r 0.04 acres of land, more or less.
Also a temporary right -of -way 25 feet in width and extending the
full length of the above described permanent right -of -way, being
located parallel and adjacent to the crest side of the above described
permanent right -of -way.
Also an additional temporary right -of -way 25 feet in width and

Harris County, Texas. The permanent right -of --way herein described being
25 feet in width on the vesterly side and 25 feet in width on the easterly
side of the follo;•ring described centerline.
Beginning at a point in the northerly line of the above described tract
of land, said point being located approximately 65 feet westerly from the
northeasterly corner thereof. Said point also being located 25 feet
westerly at a right angle from an existing 18" pipeline;
Thence parallel to said existing 18" pipeline and 25 feet therefrom,
