ORDINANCE NO. 2935
AN ORDINANCE AWARDING THE CONTRACT FOR A COMMUNITY
DEVELOPMENT REHABILITATION PROJECT 79 -03 -04 TO ED SHOOK
BUILDING CONTRACTOR, INC., FOR THE SUM OF SEVEN THOUSAND
NINE HUNDRED NINETY -NINE AND 99/100 ($7,999.99) DOLLARS.
WHEREAS, the City of Baytown did advertise for bids for
Community Development Program Rehabilitation Project 79 -03-
04 to be received June 23, 1980; and
WHEREAS, notice to bidders as to the time and place,
when and where the contract would be let was published pur-
suant to provisions of Section 74 of the Charter of the City
of Baytown; and
WHEREAS, all bids were opended and publicly read at the
Community Development Office at 10:00 a.m., Monday, June 23,
1980, as per published notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That the City Council of the City of Baytown
hereby accepts the bid of Ed Shook Building Contractor,
Inc., for the sum of Seven Thousand Nine Hundred Ninety -Nine
and 99/100 ($7,999.99) Dollars, and the City Manager and
City Clerk of the City are hereby authorized and directed to
execute and attest to a contract with Ed Shook Building
Contractor, Inc., for Community Development Rehabilitation
Project 79- 03 -04, being the repair and rehabilitation of 504
Oak Street, said contract providing that no money will be
paid to said contractor until completion and acceptance of
the work by the City.
Section 2: That pursuant to the provisions of TEX.
REV.CIV.STAT. art. 2368x, the City Manager is hereby granted
general authority to approve any change order involving a
decrease or an increase in costs of Five Thousand and No /100
00710 -13a
($5,000.00) Dollars or less, provided that the original con-
tract price may not be increased by more than twenty -five
(25 %) percent or decreased by more than twenty -five (25 %)
percent without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect from and
after its passage.
