Ordinance No. 2,9250071 0 -3 ORDINANCE NO. 2925 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF TIERRA DEL ORO SUBDIVISION, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS. WHEREAS, a public hearing before the City Council of the City of Baytown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described property, to wit: A tract or parcel of land out of the Christian Smith Survey, A -69, Harris County, Texas, being a part of that certain 90.276 acre tract conveyed by Land Equities Inc., to Bayou Ltd. by deed recorded in Volume 8324 at Page 95 of the Deed Records of Harris County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at the Northwest corner of Whispering Pines Section Four as evidenced by plat of said subdivision being recorded in Volume 275 at Page 145 of the Map Records of Harris County, Texas, said point also being situated in the centerline of a 60' wide Harris County Flood Control easement, THENCE North 090 29' 06" West with the centerline of a 60' wide Harris County Flood Control easement a distance of 572.19' to the point situated in the North line of the aforementioned 90.276 acre tract and the South Line of Cedar Bayou Estates subdivision; THENCE North 800 29' 54" East with the North line of the 90.276 acre tract and the South line of Cedar Bayou Estates subdivision a distance of 1760.14' to a point situated in the West bank of Cedar Bayou Stream; THENCE in a Southerly direction with the meanders of the West bank of Cedar Bayou Stream as follows: South 090 43' 46" East 101.611, South 120 13' 5211 East 56.1912 South 020 45' 48" East 67.60', South 160 26' 27" East 77.97', South 180 52' 04" East 35.291; South 080 22' 43" West 19.69; South 100 55' 29" East 28.49', South 070 42' 05" East 73.70', South 190 36' 34" West 36.69', South 150 03' 20" East 82.57' to a point; THENCE South 800 29' 54" West with the North line of Whispering Pines Section 4 a distance of 1753.11' to the POINT OF BEGINNING enclosing 23.1156 acres more or less. (Tierra Del Oro Subdivision) was held at 7:00 o'clock p.m. in the City Council Chamber of the City Hall of the City of Baytown, Texas, on the 26th day of June, 1980, which date is not more than twenty (20) 00710 -3a nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Baytown, Texas, and in the above described territory on the 15th day of June, 1980, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the total corporate area of the City of Baytown, Texas on the lst day of January, 1980, was 27.73 square miles; and WHEREAS, the population of the City of Baytown, Texas, is approximately 57,334 inhabitants; and WHEREAS, the above described territory lies within the extraterritorial jurisdiction of the City of Baytown, Texas; and WHEREAS, the above described territory lies adjacent to and adjoins the City of Baytown, Texas; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the following described land and territory lying adjacent to and adjoining the City of Baytown, Texas, is hereby added and annexed to the City of Baytown, Texas, and the said territory hereinafter described shall hereafter be included within the boundary limits of the City of Baytown, Texas, and the present boundary limits of such City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Baytown, Texas, to wit: A tract or parcel of land out of the Christian Smith Survey, A -69, Harris County, Texas, being a part of that certain 90.276 acre tract conveyed by Land Equities Inc., to Bayou -2- 00710 -3b Ltd. by deed recorded in Volume 8324 at Page 95 of the Deed Records of Harris County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at the Northwest corner of Whispering Pines Section Four as evidenced by plat of said subdivision being recorded in Volume 275 at Page 145 of the Map Records of Harris County, Texas, said point also being situated in the centerline of a 60' wide Harris County Flood Control easement; THENCE North 090 29' 06" West with the centerline of a 60' wide Harris County Flood Control easement a distance of 572.19' to the point situated in the North line of the aforementioned 90.276 acre tract and the South Line of Cedar Bayou Estates subdivision; THENCE North 800 29' 54" East with the North line of the 90.276 acre tract and the South line of Cedar Bayou Estates subdivision a distance of 1760.14' to a point situated in the West bank of Cedar Bayou Stream; THENCE in a Southerly direction with the meanders of the West bank of Cedar Bayou Stream as follows: South 090 43' 46" East 101.61', South 120 13' 52" East 56.19', South 020 45' 48" East 67.60', South 160 26' 27" East 77.97', South 180 52' 04" East 35.29; South 080 22' 43" West 19.69; South 100 55' 29" East 28.49', South 070 42' 05" East 73.70', South 190 36' 34" West 36.69', South 150 03' 20" East 82.57' to a point; THENCE South 800 29' 54" West with the North line of Whispering Pines Section 4 a distance of 1753.11' to the POINT OF BEGINNING enclosing 23.1156 acres more or less. (Tierra Del Oro Subdivision) Section 2: The above described territory and the area so annexed shall be a part of the City of Baytown, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Baytown, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, and regulations of the City of Baytown, Texas. Section 3: This ordinance shall be published and passed in the manner provided in Article 1, Section 9 of the Charter of the City of Baytown, Texas.
