Ordinance No. 2,916` J v41,ti4 lri ORDINANCE NO. 2916 00626 -1 AN ORDINANCE AMENDING CHAPTER 172, "MOBILE HOMES AND MOBILE HOME PARKS," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, BY THE ADOPTION OF A NEW SECTION 172 - 2(o) DEFINING HARD AND DENSE SURFACE; THE AMENDMENT OF SECTION 172 -15(7) TO PROVIDE AN EXCEPTION TO THE REQUIRE- MENT FOR SEPARATE UTILITY SERVICE; AND THE AMENDMENT OF SECTION 172- 15(14) TO REMOVE THE ACCESSIBILITY REQUIRE- MENT; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; PROVIDING FOR A MAXIMUM PENALTY OF $200.00; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown is hereby amended by the addition to Chapter 17,i "Mobile Homes and Mobile Home Parks," Section 172 -2(0) which shall read as follows: Sec. 172 -2. Definitions. (o) Smooth, hard, and dense surface. As used in this chapter, a smooth, hard, and dense surface shall mean hot mix asphaltic concrete (hot or cold laid) or reinforced concrete (5.0 sack mix). Section 2: That the Code of Ordinances of the City of Baytown is hereby amended by the repeal of 172 -15(7) as presently constituted and by substituting in its place a new subsection (7) which shall read as follows: Sec. 172 -15. Parking of mobile home outside of licensed mobile home park. (7) Mobile homes located outside mobile home parks will be connected by separate and individual water and sewer taps to the city services where such services are available. When one mobile home stands in the rear of an existing residential structure, and the mobile home and residence are on one parcel of land under one owner, such requirement shall not apply and the building sewer and water service may be extended to serve the mobile home. Section 3: That the Code of Ordinances of the City of Baytown is hereby amended by the repeal of Section 172- 15(14) as presently constituted and by substituting in its place a new subsection (14) which shall read as follows: 00626 -1a Sec. 172 -15. Parking of mobile home outside of licensed mobile home park. (14) Off- street parking areas shall be provided for all mobile homes for the use of occupants and guests. Such areas shall be furnished at the rate of not less than two (2) spaces for each mobile home. Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 5: If any provision, section, exception, sub- section, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the valid- ity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 6: Any person violating the provisions of this ordinance shall be punished by a fine of not more than Two Hundred and No /100 ($200.00) Dollars, and each violation shall constitute a separate offense. Section 7: This ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance.
