Ordinance No. 2,90700605 -1 ORDINANCE NO. 2907 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS; AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO ENTER INTO A CONTRACT WITH LAYNE - WESTERN COMPANY TO REPAIR A CITY WATER WELL; AUTHORIZING THE PAYMENT OF THE SUM OF SIXTEEN THOUSAND NINE HUNDRED SIXTY AND N01100 ($16,960.00) DOLLARS WITH REGARD TO SUCH ACCEPTANCE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the Decker Drive water well is in a present state of disrepair; and WHEREAS, the reworking of the water well so that it may provide municipal water service is necessary for the preservation and protection of the health, welfare, and safety of the citizens of the City of Baytown; and WHEREAS, considering the above, the City Council of the City of Baytown deems that an emergency situation exists; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That the City Manager and City Clerk of the City of Baytown are authorized and directed to enter into a contract with Layne - Western Company to rework the Decker Drive water well, and the payment of the sum of Sixteen Thousand Nine Hundred Sixty and No /100 ($16,960.00) Dollars is hereby authorized. Section 3: That pursuant to the provisions of TEX.REV. CiV.STAT. art. 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, subject to the proviso that the original contract price may not be increased by more than twenty -five (25 %) percent or decreased by more than twenty - five (25 %) percent without the consent of the contractor to such decrease. 00605 -1a Section 4: This ordinance shall take effect from and after its passage.
