Ordinance No. 2,90200522 -6 ORDINANCE NO. 2902 AN ORDINANCE ACCEPTING THE BID OF HITCHCOCK CONSTRUCTION SPECIALISTS, INC. FOR THE CONSTRUCTION OF THE STREET AND DRAINAGE IMPROVEMENTS TO CEDAR STREET (1979 COM14UNITY DEVELOPMENT PROGRAM) AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF TWO HUNDRED EIGHTY -SEVEN THOUSAND SEVEN HUNDRED SEVENTY -FIVE AND N01100 ($287,775.00) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown did authorize the City Engineer to advertise for bids for the construction of the street and drainage improvements to Cedar Street (1979 Community Development Program) to be received May 19, 1980; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of TEX.REV.CIV.STAT. art. 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 o'clock a.m., Monday, May 19, 1980, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section l: That the City Council of the City of Baytown hereby accepts the bid of Hitchcock Construction Specialists, Inc. according to the plans and specifications set forth by the City Engineer on a construction timetable of 150 working days for the sum of Two Hundred Eighty -Seven Thousand Seven Hundred Seventy -Five and No /100 ($287,775.00) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Hitchcock Construction Specialists, Inc. for the construction of said street and drainage improvements, containing the plans, specifications, and requirements of the City Engineer 00522 -6a and appropriate bond and drawn provisions in accordance with the provisions of TEX.REV.CIV.STAT. art. 5160. Section 2: That pursuant to the provisions of TEX.REV. CIV.STAT. art. 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, subject to the proviso that the original contract price may not be increased by more than twenty -five (25 %) percent or decreased by more than twenty - five (25 %) percent without the consent of the contractor to such decrease.
