Ordinance No. 2,90100522 -5 ORDINANCE NO. 2901 AN ORDINANCE ACCEPTING THE BID OF JAHO, INC. FOR THE CONSTRUCTION OF A TWELVE -INCH WATER MAIN ON THE SOUTH SIDE OF INTERSTATE 10 FRONTAGE ROAD, FROM THOMPSON ROAD TO THE NORTHWEST CORNER OF SAN JACINTO MALL, AND AUTHORIZING THE CONTRACTING OF INDEBTEDNESS BY THE CITY FOR THE SUM OF TWO HUNDRED SEVENTEEN THOUSAND EIGHT HUNDRED SEVENTY AND 52/100 ($217,870.52) DOLLARS WITH REGARD TO SUCH AGREEMENT. WHEREAS, the City Council of the City of Baytown did authorize the Consulting Engineers to advertise for bids for the construction of a twelve -inch water main on the south side of Interstate 10 frontage road, from Thompson Road to the northwest corner of San Jacinto Mall, to be received May 13, 1980; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of TEX.REV.CIV.STAT. art. 2368x; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 o'clock a.m., Tuesday, May 13, 1980, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Jaho, Inca according to the plans and specifications set forth by the Consulting Engineers on a construction timetable of 75 working days for the sum of Two Hundred Seventeen Eight Hundred Seventy and 52/100 ($217,870.52) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with Jaho, Inc. for the construction of said twelve -inch water main, containing the plans, speci- fications, and requirements of the Consulting Engineers and 00522 --5a appropriate bond and drawn provisions in accordance with the provisions of TEX.REV.CIV.STAT. art. 5160. Section 2: That pursuant to the provisions of TEX.REV. CIV.STAT. art. 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, subject to the proviso that the original contract price may not be increased by more than twenty -five (250) percent or decreased by more than twenty - five (25 %) percent without the consent of the contractor to such decrease.
