Ordinance No. 2,895�� 12 • ORDINANCE NO. 2895 AN ORDINANCE CLOSING AND VACATING THE UTILITY EASEMENT IN LOT 64, BLOCK 4, OF EVA MAUD SUBDIVISION, SECTION 1, AND PROVIDING FOR THE DISPOSITION OF SAID PROPERTY. WHEREAS, Section 26 -51 of the Code of Ordinances of the City of Baytown provides for the abandonment of City easements; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That, upon receipt by the City from C. J. Bailey of Three Hundred Seventy -Five and No /100 ($375.00) Dollars, the hereinafter described public utility easement in Lot 64, Block 4, of Eva Maud Subdivision, Section 1, be and the same is hereby extinguished, vacated, closed, and permanently abandoned as an easement for public utilities: the western 103.82 feet of a 6' utility easement located along the rear of said lot Section 2: That upon said receipt, the fee to the land in said easement above described is hereby released and shall revert to the owner as provided by law, and the Mayor is authorized to deliver a quitclaim deed to C. J. Bailey. Section 3: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: The necessity to abandon the easement creates a public emergency and this ordinance shall be in effect from and after its passage.
