ORDINANCE NO. 2889
AN ORDINANCE ACCEPTING THE BID OF McKEY CONSTRUCTION
AND EQUIPMENT, INC., FOR THE CONSTRUCTION OF THE WARD
ROAD DRAINAGE PROJECT AND AUTHORIZING THE CONTRACTING
OF INDEBTEDNESS BY THE CITY FOR THE SUM OF TWO HUNDRED
FORTY -SIX THOUSAND FIVE HUNDRED SEVENTY AND NO 1100
($246,570.00) DOLLARS WITH REGARD TO SUCH AGREEMENT.
WHEREAS, the City Council of the City of Baytown dial
authorize the City's Consulting Engineers to advertise for
bids for the construction of the Ward Road Drainage Project
to be received April 29, 1980; and
WHEREAS, notice to bidders as to the time and place,
when and where the contract for said construction would be
let was published pursuant to provisions of TEX.REV.CIV.STAT.
art. 2368x; and
WHEREAS, all bids were opened and publicly read at City
Hall at 10:00 a.m., Tuesday, April 29, 1980, as per published
notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section l: That the City Council of the City of Baytown
hereby accepts the bid of McKey Construction and Equipment,
Inc., according to the plans and specifications set forth by
the Consulting Engineers for the sum of Two Hundred Forty -
Six Thousand Five Hundred Seventy and No /100 ($246,570.00)
Dollars, and the Mayor and City Clerk of the City are hereby
authorized and directed to execute and attest to a contract
with McKey Construction and Equipment, Inc., for the con-
struction of said Ward Road Drainage Project containing the
plans, specifications, and requirements of the Consulting
Engineers and appropriate bond and drawn provisions in
accordance with the provisions of TEX.REV.CIV.STAT. art.
5160.

Section 2: That pursuant to the provisions of TEX.REV.
CIV.STAT. art. 2368a, the City Manager is hereby granted
general authority to approve any change order involving a
decrease or an increase in costs of Five Thousand and No /100
($5,000.00) Dollars or less, subject to the proviso that the
original contract price may not be increased by more than
twenty --five (257o) percent or decreased by more than twenty -
five (257o) percent without the consent of the contractor to
such decrease.
Section 3: This ordinance shall take effect from and
after its passage.
