AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND
CITY CLERK TO EXECUTE AND ATTEST TO A CONTRACT WITH
JAHO, INC. FOR CONSTRUCTION OF A WATER DISTRIBUTION
SYSTEM; AND MAKING OTHER PROVISIONS RELATED THERETO.
WHEREAS, the City Council has previously entered into
an agreement with Goose Creek Consolidated Independent
School District for construction, dedication, and acceptance
of a water distribution system; and
WHEREAS, Busch, Hutchison & Associates, Inc. prepared
plans and specifications for such construction and advertised
for bids for such construction; and
WHEREAS, notice to bidders as to the time and place,
when and where the contract for said construction would be
let was published pursuant to the provisions of TEX.REV.CIV.STAT.
art. 2368a; and
WHEREAS, all bids were opened and publicly read at City
Hall at 10:00 a.m., April 15, 1980, as stated in the published
notice; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BAYTOWN:
Section 1: That upon receipt from Goose Creek Consol-
idated Independent School District of the total sum of
Eighty -Nine Thousand Eighty -Nine and 40/100 ($89,089.40)
Dollars, the City Council accepts the bid of JAHO, Inc.
for a water distribution system according to the plans and
specifications set forth by Busch, Hutchison & Associates,
Inc. for the sum of One Hundred Ninety -One Thousand Six
Hundred Twenty and No /100 ($191,620.00) Dollars, and the
Mayor and City Clerk of the City are authorized and directed
to execute and attest to a contract with said contractor for
said construction, containing the plans, specifications, and
requirements of the Consulting Engineers, and appropriate

bond provisions in accordance with the provisions of TEX.
REV.CIV.STAT. art. 5160.
Section 2: That pursuant to the provisions of TEX.
REV.CIV.STAT. art 2368a, the City Manager is hereby granted
general authority to approve any change order involving an
amount of Five Thousand and No /100 ($5,000.00) Dollars or
less.
Section 3: This ordinance shall take effect from and
after its passage.
