Ordinance No. 2,87800424 -3 ORDINANCE NO. 2878 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AND ATTEST TO A CONTRACT FOR ARSON REWARD WITH GOOSE CREEK CONSOLIDATED INDEPENDENT SCHOOL DISTRICT; AND MAKING VARIOUS PROVISIONS RELATED TO THE SUBJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes and directs the Mayor and City Clerk to execute and attest to a contract for arson reward with Goose Creek Consolidated Independent School District. A copy of said agreement is attached hereto and made a part hereof for all intents and purposes. Section 2: This ordinance shall take effect from and after its passage. HALL, City Clerk APPROVED: SCOTT BOUNDS, City Attorney 00424 -3a E X H I B I T "A" 00424 -3b THE STATE OF TEXAS I I AGREEMENT TO OFFER REWARD FOR ARSON COUNTY OF HARRIS I This agreement is made and entered into this 24th day of April , 1980, by and between the CITY OF BAYTOWN, a home rule municipal corporation of the State of Texas, hereinafter called "City ", and GOOSE CREEK CONSOLIDATED INDEPENDENT SCHOOL DISTRICT, as established and existing under the laws of the State of Texas, hereinafter called "School District ". WHEREAS, on December 23, 1979, a person or persons unknown started fires resulting in significant damage to School District's buildings; and WHEREAS, the City has offered and does now offer an Arson Reward of $250.00 for information leading to the arrest and conviction of any person or persons found guilty of committing the crime of arson within the City; and WHEREAS, the School District does desire that the City increase its offer of reward in order to encourage the apprehension of the person or persons responsible for the damage; and WHEREAS, the City and the School District have the authority to enter into this agreement pursuant to Texas Revised Civil Statute, Article 4413(32c), known as the Interlocal Cooperation Act; NOW, THEREFORE, in consideration of the premises and the terms, provisions, and mutual promises herein contained, it is mutually agreed as follows: ARTICLE I. The City of Baytown does agree to offer an Arson Reward of $2,000.00 for the arrest and conviction of any person or persons found guilty of committing the crime of arson on December 23, 1979, resulting in damage to San Jacinto Elementary and Baytown Junior Schools. ADTTr'I F TT The School District does agree to reimburse the City any sum over $1,000.00 paid pursuant to this reward offer. OU424 -3c naTTri r TTT The offer of Arson Reward shall be subject to the following limitations: 1980. I. No reward shall be payable unless the criminal is captured or apprehended by December 23, 1980. 2. No reward shall be payable unless the offender is legally convicted under a judgment that is final. 3. Officers of local, state, or federal fire or police forces are not eligible for the reward. 4. The City can apportion such reward among two or more who capture or give information leading to the arrest and conviction of an offender. 5.
